The assemblyman who introduced it has moved to withdraw the bill from consideration.<\/p>\n<p><strong><span>Fact Check:<\/span><\/strong><\/p>\n<p>The image is a screen grab of a <a href=\"https:\/\/twitter.com\/ChuckCallesto\/status\/1472374424749981697\" target=\"_blank\" rel=\"noopener noreferrer\">recent tweet<\/a> from former Florida congressional candidate Chuck Callesto that reads, \u201cBREAKING REPORT: New York Legislation set for vote on January 5th, 2022 Provides for INDEFINITE DETENTION OF UNVACCIANTED at Governor\u2019s Discression (<em>sic<\/em>).\u201d Callesto\u2019s tweet has garnered over 7,100 retweets as of press time.<\/p>\n<p>The post appears to be discussing <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2021\/a416\" target=\"_blank\" rel=\"noopener noreferrer\">A.416<\/a>, a bill pertaining to the \u201cremoval of cases, contacts and carriers of communicable diseases who are potentially dangerous to the public health.\u201d New York Assemblyman <a href=\"https:\/\/nyassembly.gov\/mem\/N-Nick-Perry\" target=\"_blank\" rel=\"noopener noreferrer\">N. Nick Perry<\/a> first introduced the bill in 2015 and has done so in legislative sessions since then, including the 2021-2022 one, according to the <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2021\/a416\" target=\"_blank\" rel=\"noopener noreferrer\">New York State Senate website<\/a>.<\/p>\n<p>There is, however, no plan to move forward with the bill, and the New York State Legislature is not voting on it Jan. 5, 2022, the date the <a href=\"https:\/\/nyassembly.gov\/leg\/calendar\/\" target=\"_blank\" rel=\"noopener noreferrer\">next legislative session<\/a> starts. The <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2021\/a416\" target=\"_blank\" rel=\"noopener noreferrer\">New York State Senate website<\/a> shows the most recent action on A.416 \u2013 \u201cenacting clause stricken\u201d \u2013 took place Dec. 22 and, before that, the most recent action was on Jan. 6, 2021, when it was referred to committee. The bill has <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2015\/A6891\" target=\"_blank\" rel=\"noopener noreferrer\">never<\/a> <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2017\/A680\" target=\"_blank\" rel=\"noopener noreferrer\">moved<\/a> <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2019\/A99\" target=\"_blank\" rel=\"noopener noreferrer\">past<\/a> the stage of being referred to committee during any of the legislative sessions it was introduced, according to the <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2021\/a416\" target=\"_blank\" rel=\"noopener noreferrer\">New York State Senate website<\/a>.<\/p>\n<p>The Dec. 22 \u201cenacting clause stricken\u201d action came after Perry said in a <a href=\"https:\/\/twitter.com\/NNickPerry\/status\/1473052925996015616\" target=\"_blank\" rel=\"noopener noreferrer\">Dec. 20 tweet<\/a> that he would \u201ctake appropriate legislative action\u201d to strike the bill. <strong><a href=\"https:\/\/checkyourfact.com\/2021\/10\/05\/fact-check-infrastructure-bill-contain-bailout-for-media\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Does The Bipartisan Infrastructure Bill Contain A $1.3 Billion \u2018Bailout\u2019 For The Media?)<\/a><\/strong><\/p>\n<p>\u201cConspiracy theorists, and those who spread misinformation online are once again trolling on social media, posting concocted stories about A.416,\u201d he tweeted. \u201cTo deprive these individuals the ability to use this issue for fuel to spread their fire of lies and mistruths, I will take appropriate legislative action to strike the bill, remove it from the calendar, thus ending all consideration, and actions that could lead to passage into law.\u201d<\/p>\n<p>In early January of this year, Perry posted a statement on <a href=\"https:\/\/www.facebook.com\/nnickperry\/posts\/10220947962547564\" target=\"_blank\" rel=\"noopener noreferrer\">his Facebook page<\/a> addressing A.416. He explained at the time that the bill was \u201cinitially introduced to address public health concerns related to the containment of the Ebola virus after it was discovered that Ebola infected persons had entered the United States.\u201d<\/p>\n<p>A.416 <a href=\"https:\/\/legislation.nysenate.gov\/pdf\/bills\/2021\/A416\" target=\"_blank\" rel=\"noopener noreferrer\">does not contain<\/a> any instances of the word \u201cunvaccinated,\u201d a review of the bill\u2019s text by Check Your Fact found.
