The new Ohio law would eliminate that variance.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Nilani Jawahar, legislative liaison for the Center for Christian Virtue (CCV), <a href=\"https:\/\/www.ccv.org\/news\/dewine-signs-born-alive-act\">said<\/a>:<\/p>\n<blockquote>\n<p>Today the state of Ohio has made a bold statement about where our values lie\u2014with women, children, and families\u2014not with the abortion industry which demeans and exploits them. Anthony List sponsored a poll in February 2019 that&nbsp;<a href=\"https:\/\/s27319.pcdn.co\/wp-content\/uploads\/2019\/02\/National-SBA-List-Slides-February.pdf\">found<\/a>&nbsp;77 percent of Americans support legislation that would ensure babies who survive abortion would be administered the same medical treatment as would any infant born prematurely at the same age.<\/p>\n<p>That outcome included 75 percent of independent voters and 70 percent of Democrats.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">President Donald Trump announced Wednesday during the National Catholic Prayer Breakfast he will be signing an executive order that ensures all babies born alive, including those surviving abortion, receive the medical care they need. <a href=\"https:\/\/t.co\/1iSZKLDcMe\">https:\/\/t.co\/1iSZKLDcMe<\/a><\/p>\n<p>\u2014 Breitbart News (@BreitbartNews) <a href=\"https:\/\/twitter.com\/BreitbartNews\/status\/1309112359936569347?ref_src=twsrc%5Etfw\">September 24, 2020<\/a><\/p>\n<\/blockquote>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>Planned Parenthood referred in a statement to the new Ohio law as \u201ca stigmatizing bill that sets out to create a law that already exists.\u201d<\/p>\n<p>Abortion rights activists frequently use talking points that claim a Born-Alive Act, at the federal level, is not \u201cnecessary\u201d because Congress already passed the 2002 Born-Alive Infants Protection Act, or because infanticide is already illegal under homicide laws.<\/p>\n<figure id=\"D-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Patrina Mosley, Family Research Council\u2019s director of Life, Culture, and Women\u2019s Advocacy,&nbsp;<a href=\"https:\/\/www.frc.org\/op-eds\/why-we-need-the-born-alive-abortion-survivors-protection-act\">addressed<\/a>&nbsp;this issue in February 2020:<\/p>\n<blockquote>\n<p>Congress did pass the 2002&nbsp;Born-Alive Infants Protection Act, but that was only a&nbsp;<a href=\"https:\/\/www.congress.gov\/107\/plaws\/publ207\/PLAW-107publ207.pdf\">definitional change<\/a>&nbsp;stating that all infants who survive abortion are full persons under the law. It neither required any medical care for infants born-alive nor included a provision for prosecuting anyone who failed to provide care.<\/p>\n<\/blockquote>\n<p>Mosley also referred to the murder conviction of Philadelphia abortionist&nbsp;Kermit Gosnell to make another point about homicide law:<\/p>\n<blockquote>\n<p>Under current homicide law, there is a distinction between active and passive killing. Active killing is what happened with Pennsylvania abortionist Kermit Gosnell, when he snipped the necks and spines of infants who were, according to him, \u201cbig enough to walk him to the bus stop.\u201d Eyewitnesses who worked with Texas abortionist Douglas Karpen&nbsp;<a href=\"https:\/\/www.dailymail.co.uk\/news\/article-2325786\/Douglas-Karpen-Second-house-horrors-abortion-clinic-investigated-Texas.html\">testified<\/a>&nbsp;that he regularly killed babies born alive by snipping their spinal cords, fatally injuring them with blows to the soft spot on their heads, and twisting their necks.<\/p>\n<p>Gosnell was convicted on three counts of murder under a Pennsylvania homicide statute that included prosecutions for infanticide.<\/p>\n<\/blockquote>\n<p>\u201cBut what about an abortionist that simply leaves the infant to die?\u201d Mosley asked. \u201cThe&nbsp;Born-Alive Abortion Survivors Protection Act&nbsp;would require an active duty physician to treat a child that needs help when he or she is born alive after an abortion. If you kill that child you will have committed murder. At present, if you leave the child to die, you\u2019re not guilty of anything.\u201d<\/p>\n<figure id=\"M-ROS-B4\" class=\"a8d adSo\"><\/figure>\n<p>Melanie Israel, research associate at the Heritage Foundation, also&nbsp;<a href=\"https:\/\/www.heritage.org\/life\/report\/the-necessity-the-born-alive-abortion-survivors-protection-act\">noted<\/a>&nbsp;in February 2019 that current federal policy is not sufficient to protect babies who survive a botched abortion.<\/p>\n<p>The 2002 Born-Alive Act \u201cclarifies for purposes of federal law that \u2018every infant \u2026 who is born alive at any stage of development\u2019 is a \u2018person,\u2019 regardless of the circumstances\u2014including induced abortion\u2014surrounding birth,\u201d Israel observed. \u201cBut it does not specify the obligations surrounding&nbsp;duty of care&nbsp;for such infants.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">\ud83d\udea8 | BREAKING:  Minutes ago, Ohio Gov.
