In light of today\u2019s Office of Legal Counsel opinion, I have directed that the Department engage in a rulemaking process to ensure that the Department lives up to the letter and spirit of the CARES Act,\u201d Attorney General Merrick Garland <a href=\"https:\/\/www.justice.gov\/opa\/pr\/statement-attorney-general-merrick-b-garland-0\" target=\"_blank\" rel=\"noopener noreferrer\">said<\/a>.<\/p>\n<div id=\"attachment_7341514\" class=\"wp-caption alignnone\">\n<p id=\"caption-attachment-7341514\" class=\"wp-caption-text\">WASHINGTON, DC \u2013 DECEMBER 06: Attorney General Merrick B. (Anna Moneymaker\/Getty Images)<\/p>\n<\/div>\n<p>\u201cWe will exercise our authority so that those who have made rehabilitative progress and complied with the conditions of home confinement, and who in the interests of justice should be given an opportunity to continue transitioning back to society, are not unnecessarily returned to prison.\u201d<\/p>\n<p>Under the CARES Act, Congress allowed prisoners to be released for home confinement based on several factors like their age, health and duration of sentence. <strong><a href=\"https:\/\/dailycaller.com\/2021\/08\/12\/new-jersey-man-alleged-murder-covid-19-prison\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Man Charged With Murdering 18-Year-Old 2 Days After Being Released From Prison Due To COVID-19: REPORT)<\/a><\/strong><\/p>\n<p>The Trump administration previously issued a memo that <a href=\"https:\/\/dailycaller.com\/2021\/03\/17\/republicans-introduce-legislation-prevent-taxpayer-funded-checks-going-prisoners-bryan-steil\/\" target=\"_blank\" rel=\"noopener noreferrer\">inmates<\/a> who did not serve out their <a href=\"https:\/\/dailycaller.com\/2020\/03\/17\/nyc-corrections-board-empty-jails-public-health-crisis\/\" target=\"_blank\" rel=\"noopener noreferrer\">sentence<\/a> during the pandemic would have to return to prison to do so. Following pressure from prison reform advocates, the Biden administration changed course and accepted the Office of Legal Counsel\u2019s opinion.<\/p>\n<p>Between March of 2020 and Dec. 6, 2021, 35,277 <a href=\"https:\/\/dailycaller.com\/2020\/04\/22\/coronavirus-jails-inmates-released-arrested-murder-carjacking\/\" target=\"_blank\" rel=\"noopener noreferrer\">inmates<\/a> have been placed in home confinement, according to the opinion.
