Or transmission,\u201d tweeted Berenson. \u201cDon\u2019t think of it as a vaccine. Think of it \u2014 at best \u2014 as a therapeutic with a limited window of efficacy and terrible side effect profile that must be dosed IN ADVANCE OF ILLNESS.\u201d<\/p>\n<p>\u201cAnd we want to mandate it? Insanity.\u201d<\/p>\n<\/blockquote>\n<p>The lawsuit states that Berenson\u2019s claims about the vaccine were true. The legal complaint claims: \u201cIt is undisputed that vaccinated persons can contract and spread COVID-19.\u201d<\/p>\n<p>The lawsuit was filed in the U.S. District Court for Northern California, and argues that California laws defining common carriers as any company that \u201coffers to the public to carry persons, property, or messages\u201d limit Twitter\u2019s right to censor its users.<\/p>\n<p>Berenson\u2019s lawyers also argue that Twitter responded to U.S. government demands in taking down his account, citing the \u201cThe extraordinarily close nexus between the July 2021 statements by senior executive branch&nbsp;officials\u2014including President Biden himself\u2014calling for censorship by such companies and&nbsp;Twitter\u2019s corresponding immediate actions against Mr. Berenson.\u201d<\/p>\n<p>Twitter and other tech giants have previously used the legal immunities ostensibly granted to them by Section 230 of the Communications Decency Act to defeat similar lawsuits, a fact Berenson\u2019s lawyers acknowledge in their complaint.
