The&nbsp;27&nbsp;states and several other applicants are additionally requesting their&nbsp;filings be considered a petition for writ of certiorari, meaning they are asking the Supreme Court to take up the case this term.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>\u201cIn addition and in the alternative, the Court should treat this application as a petition for certiorari before judgment and grant immediate review of the Vaccine Mandate\u2019s legality,\u201d the states\u2019 <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/21\/21A247\/205640\/20211218002842314_SCOTUS%20Stay%20Request%20-%20OSHA.pdf\">emergency application<\/a> reads.<\/p>\n<p>The emergency requests come after the Sixth Circuit on Saturday&nbsp;<a title=\"This external link will open in a new window\" href=\"https:\/\/www.breitbart.com\/politics\/2021\/12\/18\/federal-court-allows-bidens-osha-mandate-businesses-resume\/\" target=\"_blank\" rel=\"noopener noreferrer\">dissolved a stay<\/a>&nbsp;of Biden\u2019s vaccine mandate issued by the Fifth Circuit in November. Though the Sixth Circuit has a&nbsp;conservative&nbsp;judge majority&nbsp;9-7, a three judge panel, including a President Barack Obama appointee and a President George W. Bush appointee with a reputation as a liberal-leaning moderate,&nbsp;<a title=\"This external link will open in a new window\" href=\"https:\/\/www.opn.ca6.uscourts.gov\/opinions.pdf\/21a0287p-06.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">voted<\/a>&nbsp;2-1, with a President Donald Trump appointee penning the dissent.<\/p>\n<p>Biden\u2019s mandate,&nbsp;issued&nbsp;by the&nbsp;Occupational Safety and Health Administration (OSHA), is the largest of the president\u2019s five vaccine mandates and impacts 84 million workers.<\/p>\n<p>The applications are&nbsp;<em>In re: MCP No. 165 v.
