Bush appointee Judge Julia Gibbons, who has a reputation as a liberal-leaning moderate, voted to dissolve&nbsp;the&nbsp;stay on Biden\u2019s&nbsp;coronavirus&nbsp;vaccine mandate granted earlier by the Fifth Circuit. President Donald Trump appointee Judge Joan Larsen dissented. The Occupational Safety and Health Administration (OSHA) mandate will take effect on January 4, though it allows unvaccinated workers to submit to weekly testing in lieu of getting jabbed.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<div id=\"attachment_18816210\" class=\"wp-caption aligncenter\" readability=\"32\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/11\/vaccine-protest-no-jobs-california-getty.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-18816210\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/11\/vaccine-protest-no-jobs-california-getty.jpg\" alt width=\"640\" height=\"480\" \/><\/a><\/p>\n<p class=\"wp-caption-text\">Justin Sullivan\/Getty Images<\/p>\n<\/div>\n<p><em>Politico<\/em>&nbsp;<a href=\"https:\/\/www.politico.com\/news\/2021\/12\/17\/appeals-court-lifts-stay-vaccine-or-test-525313\">reported<\/a> that 27 businesses responded late Friday night by&nbsp;applying&nbsp;to the Supreme Court&nbsp;for a stay, asking the justices to reinstate&nbsp;an order from another appeals court \u2013 the Fifth Circuit \u2013 that had blocked&nbsp;Biden\u2019s mandate&nbsp;in November shortly after it was issued,&nbsp;asserting that the OSHA rule will \u201charm\u201d thousands of businesses across the country.<\/p>\n<p><span>\u201cThis mandate adds an incredible burden on small business owners who are still suffering negative effects of the pandemic. This mandate will make it even harder for small business owners to find and keep employees,\u201d the Job Creators Network said in a statement.&nbsp;<\/span><span>\u201cThe [Sixth] Circuit irresponsibly upheld an illegal rule and expects employers to somehow comply with a complicated regulation in a period of two weeks, including the holidays. JCN has immediately asked the Supreme Court to save businesses and employees from this government overreach.\u201d<\/span><\/p>\n<p><span>The case ended up in the Sixth Circuit following a&nbsp;<\/span><span><a href=\"https:\/\/www.breitbart.com\/politics\/2021\/11\/18\/ping-pong-ball-lottery-sends-bidens-vaccine-mandate-to-sixth-circuit\/\">ping-pong ball lottery<\/a> in mid-November.&nbsp;<\/span><span>A ping-pong lottery occurs when&nbsp;multiple&nbsp;petitions for review&nbsp;are filed against the same agency, person, or business in various courts of appeal around the country. To save time and&nbsp;avoid&nbsp;contradictory&nbsp;outcomes, the numbers of the courts in which the suits are filed are written on ping-pong balls, stuck in a solid wood raffle drum, and one is randomly selected. <\/span><span>The lottery allowed at least 34 different lawsuits brought against Biden\u2019s mandate in 12 different courts of appeals to be heard all together.&nbsp;<\/span><\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p><span>The Sixth Circuit, which has a Republican judge majority 10-6, dissolved the stay issued by the Fifth Circuit in November \u2014 a court widely considered the most conservative-leaning court of appeals.&nbsp;<\/span><\/p>\n<p>The&nbsp;New Orleans-based Fifth Circuit originally held:<\/p>\n<blockquote readability=\"9\">\n<p>Rather than a delicately handled scalpel, the Mandate is a one-size- fits-all sledgehammer that makes hardly any attempt to account for differences in workplaces (and workers) that have more than a little bearing on workers\u2019 varying degrees of susceptibility to the supposedly \u2018grave danger\u2019 the Mandate purports to address.<\/p>\n<\/blockquote>\n<p>Judge Stranch of the Sixth Circuit disagreed, writing that the mandate is necessary to stop the transmission of the coronavirus. (Photo by DANIEL LEAL-OLIVAS \/ AFP) (Photo by DANIEL LEAL-OLIVAS\/AFP via Getty Images)\" width=\"640\" height=\"480\" \/><\/a><\/p>\n<p class=\"wp-caption-text\">DANIEL LEAL-OLIVAS\/AFP via Getty Images<\/p>\n<\/div>\n<p>\u201cRecognizing that the \u2018old normal\u2019 is not going to return, employers and employees have sought new models for a workplace that will protect the safety and health of employees who earn their living there,\u201d she wrote. \u201cIn need of guidance on how to protect their employees from COVID-19 transmission while reopening business, employers turned to the Occupational Safety and Health Administration.\u201d<\/p>\n<p>Stranch further contended that the costs of delaying the implementation of the mandate are \u201ccomparatively high.\u201d<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>She continued:<\/p>\n<blockquote readability=\"13\">\n<p>Fundamentally, the [mandate] is an important step in curtailing the transmission of a deadly virus that has killed over 800,000 people in the United States, brought our healthcare system to its knees, forced businesses to shut down for months on end, and cost hundreds of thousands of workers their jobs.<\/p>\n<\/blockquote>\n<p>Judge Gibbons wrote a concurring opinion, saying the court\u2019s only \u201cresponsibility\u201d is to determine if OSHA has acted \u201cwithin the bound of its statutory authority\u201d and contending \u201cit likely has done so.\u201d<\/p>\n<p>Judge Larsen, in her dissent, said the majority did not take into account if Congress \u201cauthorized the action the agency took.\u201d<\/p>\n<p>Larsen wrote;<\/p>\n<blockquote readability=\"9\">\n<p>That question is the bread and butter of federal courts. And this case can be resolved using ordinary tools of statutory interpretation and bedrock principles of administrative law. These tell us that petitioners are likely to succeed on the merits, so I would stay OSHA\u2019s emergency rule pending final review.<\/p>\n<\/blockquote>\n<p>The applications for a stay have been submitted to Justice Brett Kavanaugh as the circuit justice who supervises the Sixth Circuit.<\/p>\n<p>The cases are consolidated under the name&nbsp;<em>In re MCP No. 165<\/em>, No. 21-7000, in the U.S. Court of Appeals for the Sixth Circuit.<\/p>\n<p><em>Katherine Hamilton is a political reporter for Breitbart News.
