This court, the U.S. Court of Appeals for the 5th Circuit, issued a temporary pause halt of the rule and the Occupational Safety and Health Administration (OSHA) <a href=\"https:\/\/dailycaller.com\/2021\/11\/17\/osha-suspends-implementation-enforcement-joe-biden-private-business-vaccine-rule-court-order\/\">subsequently<\/a> suspended its implementation and enforcement because of the court order.<\/p>\n<p>Friday\u2019s 2-1 ruling by the U.S. Appeals Court for the Sixth Circuit allows for the Biden administration to enforce the requirement, though the battle is likely far from over. The case is expected to ultimately be decided by the Supreme Court, <a href=\"https:\/\/www.foxbusiness.com\/politics\/federal-appeals-court-allows-biden-vaccine-mandate-for-large-companies-to-resume\">according<\/a> to Fox Business. <strong><a href=\"https:\/\/dailycaller.com\/2021\/09\/10\/big-business-groups-joe-biden-vaccine-mandate-coronavirus\/\">(RELATED:&nbsp;\u2018A Decision We Applaud\u2019 \u2014 Big Business Endorses Biden\u2019s Vaccine Mandate)<\/a><\/strong><\/p>\n<p>\u201cRecognizing that the \u2018old normal\u2019 is not going to return, employers and employees have sought new models for a workplace that will protect the safety and health of employees who earn their living there,\u201d Judge Jane Branstetter Stranch, appointed by former President Barack Obama, wrote in the ruling for the majority, according to Fox Business.&nbsp;<i><strong>\u201c<\/strong><\/i>In need of guidance on how to protect their employees from COVID-19 transmission while reopening business, employers turned to the Occupational Safety and Health Administration \u2026 the federal agency tasked with assuring a safe and healthful workplace.\u201d<\/p>\n<div id=\"attachment_7339682\" class=\"wp-caption aligncenter\" readability=\"40\">\n<p id=\"caption-attachment-7339682\" class=\"wp-caption-text\">MIAMI, FLORIDA \u2013 DECEMBER 16: A healthcare worker administers a Pfizer-BioNTech COVID-19 vaccine to a person at a drive-thru site in Tropical Park on December 16, 2021 in Miami, Florida. (Photo by Joe Raedle\/Getty Images)<\/p>\n<\/div>\n<p>Still, the announcement is a small sigh of relief for the <a href=\"https:\/\/dailycaller.com\/2021\/11\/08\/white-house-private-businesses-move-ahead-joe-biden-vaccine-rule\/\">administration<\/a>, which continued to push for private businesses to move forth with the vaccine or testing requirement despite the pause. White House press secretary Jen Psaki <a href=\"https:\/\/dailycaller.com\/2021\/11\/18\/white-house-businesses-move-forward-bidens-vaccine-rule-osha-suspends-enforcement\/\">said<\/a> on Nov. 18 that the administration was still operating with its original <a href=\"https:\/\/dailycaller.com\/2021\/11\/04\/private-businesses-january-4-joe-biden-vaccine-testing-requirement\/\">Jan. 4<\/a> compliance deadline in mind.<\/p>\n<p>\u201cLet me be very clear: Our message to businesses right now is to move forward with measures that will make their workplaces safer and protect them \u2013 their workforces \u2013 from COVID-19,\u201d Psaki said at the time. \u201cThat was our message after the first day issued by the Fifth Circuit. That remains our message and nothing has changed.\u201d<\/p>\n<p>\u201cThey\u2019re essentially implementing components or versions of these vaccine requirements because they know it\u2019s in the interests of their workforces \u2013 to protect their workforces, to make sure they can bring more people back to the workforce. And we certainly see that as a positive sign,\u201d Psaki continued. \u201cSo, we are still heading towards the same timeline.\u201d<\/p>\n<p>The ruling coincides with rising fear over the Omicron variant. Though scientists are still learning more about this variant, it is believed to be more transmissible but perhaps have less severe illnesses than previous coronavirus variants.
