Kristi Noem (R) has advanced a bill in the state legislature that would codify her executive orders limiting transgender athletes to competing only in categories that correspond to their birth gender.<\/p>\n<p>Noem <a href=\"https:\/\/www.argusleader.com\/story\/news\/education\/2021\/12\/14\/gov-kristi-noem-introduces-south-dakota-legislation-ban-transgender-women-girls-sports\/8894344002\/\" target=\" _blank\" rel=\"noopener\">filed<\/a> the bill on Tuesday to limit K-12 girl\u2019s school sports and state-funded colleges to allowing only natural-born girls to compete in girl\u2019s categories, according to the <i>Argus Leader<\/i>.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>The governor issued her two executive orders in March after the legislature rejected her revisions of House Bill 1217.<\/p>\n<p>\u201cOnly girls should play girls\u2019 sports. Given the legislature\u2019s failure to accept my proposed revisions to HB 1217, I am immediately signing two executive orders to address this issue: one to protect fairness in K-12 athletics, and another to do so in college athletics,\u201d Noem <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/03\/29\/ssd-gov-noem-reacts-to-lawmakers-rejection-of-trans-bill-revision-with-executive-orders\/\" target=\" _blank\" rel=\"noopener\">tweeted<\/a> on March 29. \u201cAdditionally, I will be working with legislative leaders to schedule a special legislative session in late May or early June. The special session will address this important issue, as well others (medicinal marijuana and the latest federal spending package),\u201d she added.<\/p>\n<p>Despite the governor\u2019s orders, the state\u2019s South Dakota High School Activities Association did not alter its policy of allowing transgender athletes to pick whatever category they want to play in.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>\u201cOnly female athletes, based on their biological sex, may participate in any team, sport, or athletic event designated as being for females, women, or girls,\u201d Noem\u2019s new bill reads. The bill defines sex as that assigned at birth.<\/p>\n<p>The new bill adds that students who suffer harm by violations of the law will be awarded grounds to sue a school district, sports league, or college for such violations. A two-year statute of limitations is also appended to any particular incident.<\/p>\n<p>Supporters of transgender people blasted the governor\u2019s bill.<\/p>\n<p>\u201cGov. Noem\u2019s proposed legislation is clearly fueled by a fear and misunderstanding of transgender people in our state,\u201d said Jett Jonelis of the ACLU of South Dakota. \u201cGov.
