No input from Congress, no ordinary rulemaking procedures, and no judicial review.<\/p>\n<\/blockquote>\n<p>\u201cWe address and reject each of the Government\u2019s reviewability arguments and determine that DHS has come nowhere close to shouldering its heavy burden to show that it can make law in a vacuum,\u201d he added.<\/p>\n<p>The Migrant Protection Protocols (MPP), commonly known as \u201cRemain in Mexico,\u201d is a Trump-era immigration policy that requires migrants seeking asylum in the U.S. to wait in Mexico for their U.S. court hearings.<\/p>\n<div id=\"attachment_18463282\" class=\"wp-caption alignnone\" readability=\"37\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/12\/Migrants-Gather-at-U.S.-Mexico-Border.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-18463282\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/12\/Migrants-Gather-at-U.S.-Mexico-Border.jpg\" alt=\"Haitian migrants remain outside a migrant shelter where they await their immigration resolution, in Monterrey, Mexico, on September 26, 2021. - Almost all of the mostly Haitian migrants who had gathered on both sides of the US-Mexico border have left their makeshift camps, ending a standoff that had provoked a major border crisis for the Biden administration. (Photo by JULIO CESAR AGUILAR\/AFP via Getty Images)<\/p>\n<\/div>\n<p>The Fifth Circuit\u2019s Monday decision upholds a federal court ruling from August that held Biden unlawfully ended the MPP and ordered the U.S. Department of Homeland Security (DHS) to renew the program.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>President Joe Biden suspended MPP on his first day in office, then DHS Secretary Alejandro Mayorkas issued a memo in June terminating the policy.<\/p>\n<p>After Judge Matthew Kacsmaryk of the U.S. District Court for the Northern District of Texas determined the administration did not give sufficient justification for ending MPP, Mayorkas issued a new memo, once again terminating MPP in October.<\/p>\n<p>However, the Fifth Circuit criticized the administration\u2019s strategy, saying, \u201cThe Government cannot use this have-its-cake-and-eat-it-too strategy to moot the case.\u201d<\/p>\n<p>Texas Attorney General Ken Paxton applauded the court\u2019s decision, calling it a \u201cbig victory for border security.<\/p>\n<p>\u201cOnce again \u2014 the court rejects the Biden\u2019s Administration\u2019s capricious attempts at scraping the \u2018Remain in Mexico\u2019 policy.
