It also protects institutions who are in compliance with the law from being sued by transgender athletes.<\/p>\n<p>Noem also released a statement Tuesday announcing the proposed law and speaking out against recent controversies over <a href=\"https:\/\/www.dailywire.com\/news\/watch-heres-what-it-looked-like-when-u-penn-trans-swimmer-destroyed-female-competition\">biological males competing in women\u2019s sports<\/a>. The <a href=\"https:\/\/www.dailywire.com\/news\/noem-every-young-woman-deserves-an-even-playing-field\">Daily Wire<\/a> reported:<\/p>\n<p><em>\u201cThis is about fairness. Every young woman deserves an equal playing field where she can achieve success, but common sense tells us that males have an unfair physical advantage over females in athletic competition. It is for those reasons that only girls should be competing in girls\u2019 sports,\u201d Noem said in the statement.<\/em><\/p>\n<p><em>\u201cWomen have fought long and hard for equal athletic opportunities, and South Dakota will defend them, but we have to do it in a smart way,\u201d she added.<\/em><\/p>\n<p>Noem was at the center of controversy in March 2021 for refusing to sign a law that would have banned transgender athletes from competing in girls\u2019 and women\u2019s sports.<\/p>\n<p>Noem\u2019s \u201c<a href=\"https:\/\/www.dailywire.com\/news\/conservatives-blast-gop-gov-noem-for-refusing-to-sign-bill-protecting-girls-sports\">style and form<\/a>\u201d veto stripped the language addressing collegiate athletics as well as the language that would have provided female athletes with legal recourse if they were harmed by transgender athletes competing in their chosen sport.<\/p>\n<p>\u201cUnfortunately, as I have studied this legislation and conferred with legal experts over the past several days, I have become concerned that this bill\u2019s vague and overly broad language could have significant unintended consequences,\u201d Noem said at the time, as the Daily Wire reported. \u201cI am also concerned that the approach House Bill 1217 takes is unrealistic in the context of collegiate athletics.\u201d<\/p>\n<p>Noem instead signed a pair of <a href=\"https:\/\/www.dailywire.com\/news\/gov-kristi-noem-passes-on-south-dakota-womens-sports-bill-issues-executive-orders-instead\">executive orders<\/a> that directed state agencies to construct policies protecting girls\u2019 sports in South Dakota.<\/p>\n<p>The move drew harsh criticism from members of the South Dakota legislature and conservative advocacy groups, who accused her of caving to the NCAA and corporate interests.
