Jim McGovern and Republican Florida Sen. Marco Rubio.<\/p>\n<p>The latest version will receive a vote Tuesday, and then be sent to the Senate for \u201cswift action,\u201d Speaker of the House Nancy Pelosi said in a <a href=\"https:\/\/www.speaker.gov\/newsroom\/121421-0\">statement<\/a>. It creates a \u201crebuttable presumption\u201d that goods produced in Xinjiang or by certain listed Chinese business entities are produced by the forced labor of Uyghurs or other ethnic minorities. A previous version of the House bill did not address <a href=\"https:\/\/www.rfa.org\/english\/news\/uyghur\/uyghur-forced-labor-11132021101447.html\">reports<\/a> that Chinese companies and the government are transporting Uyghurs and members of other minority groups outside of Xinjiang to participate in forced labor. <strong><a href=\"https:\/\/dailycaller.com\/2020\/12\/30\/uighur-slave-labor-companies-brands-china\/\">(RELATED: Here Are The Companies Linked To Forced Uighur Slave Labor)<\/a><\/strong><\/p>\n<p>Companies may continue to import products from Xinjiang if they provide \u201cclear and convincing evidence\u201d to the Commissioner of Customs and Border Protection that their supply chains do not include forced labor.<\/p>\n<p><strong>Read the bill here:<\/strong><\/p>\n<p><a title=\"View MCGOVE_031_xml on Scribd\" href=\"https:\/\/www.scribd.com\/document\/546953808\/MCGOVE-031-xml#from_embed\">MCGOVE_031_xml<\/a> by <a title=\"View Michael Ginsberg&#039;s profile on Scribd\" href=\"https:\/\/www.scribd.com\/user\/548087574\/Michael-Ginsberg#from_embed\">Michael Ginsberg<\/a> on Scribd<\/p>\n<p>The consensus version eliminates a reporting requirement to the Securities and Exchange Commission, which had previously been included in the House version. The consensus version also gives companies 180 days to comply with the new import ban, whereas the Senate version offered 300, and the previous House version offered 120.<\/p>\n<p>The Senate <a href=\"https:\/\/dailycaller.com\/2021\/07\/15\/uyghur-forced-labor-prevention-act-xinjiang-rubio-merkley\/\">passed<\/a> a version of the Uyghur Forced Labor Prevention Act by voice vote in July, but when the House did not immediately take up the legislation, Rubio attempted to insert it as an amendment to the National Defense Authorization Act. The House <a href=\"https:\/\/dailycaller.com\/2021\/12\/08\/uyghur-forced-labor-prevention-act-passes-house-jim-mcgovern\/\">passed<\/a> McGovern\u2019s version of the bill on Dec. 8 in a 428-1 vote.<\/p>\n<p>The five month wait, along with the opposition of major companies like <a href=\"https:\/\/dailycaller.com\/2020\/12\/03\/nike-coca-cola-corporations-fighting-slave-labor-uyghur-muslims-china-africa\/\">Nike<\/a> and Coca-Cola, led some observers to suspect that the Biden administration was attempting to kill or water down the bill. The Washington Post\u2019s Josh Rogin <a href=\"https:\/\/www.washingtonpost.com\/opinions\/2021\/12\/02\/congress-needs-act-xi-jinpings-genocide-now\/\">reported<\/a> that Deputy Secretary of State Wendy Sherman encouraged Democratic Oregon Sen. Jeff Merkley to shrink the scope of the legislation, while <a href=\"https:\/\/twitter.com\/marcorubio\/status\/1469332767745974278\">Rubio<\/a> and Minority Leader Kevin McCarthy accused Pelosi of attempting to kill the legislation.<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"10.438438438438\">\n<p dir=\"ltr\" lang=\"en\">The House passed 30+ bills yesterday. What does the Chinese Communist Party have on her?<\/p>\n<p>\u2014 Kevin McCarthy (@GOPLeader) <a href=\"https:\/\/twitter.com\/GOPLeader\/status\/1469148466102386690?ref_src=twsrc%5Etfw\">December 10, 2021<\/a><\/p>\n<\/blockquote>\n<p>White House press secretary Jen Psaki <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/press-briefings\/2021\/12\/03\/press-briefing-by-press-secretary-jen-psaki-december-3-2021\/\">denied<\/a> the allegations against Sherman, saying that the Biden administration is \u201cnot lobbying in any way against the passage of this bill.\u201d She characterized Sherman\u2019s conversation with Merkley as \u201ctechnical assistance.\u201d Psaki <a href=\"https:\/\/www.axios.com\/uyghur-forced-labor-bill-rubio-congress-d4699c95-16ea-4b42-bda4-eb5baa29326a.html\">confirmed<\/a>&nbsp;Tuesday that President Joe Biden will sign the bill once the Senate passes it.<\/p>\n<p>A House Democratic staffer with knowledge of the situation denied reports that the Biden administration encouraged House Democrats to slow-walk the legislation. The staffer also noted that the House initially passed the bill in 2020, but that senators could not come to an agreement on the legislation before the end of the 116th Congress.<\/p>\n<p>Both the Trump and Biden administrations have determined that China is committing genocide against the Uyghurs. In addition to forced labor, China has subjected Uyghurs to re-education camps, forced sterilization, and mass rape.<\/p>\n<p>\u201cThankfully, in the end this turned out to be a good episode of bipartisan cooperation\u2014one that all parties involved will hopefully seek to replicate in other areas.
