He is still awaiting sentencing, and is facing up to&nbsp;three years in prison for the charges&nbsp;<a href=\"https:\/\/www.nbcchicago.com\/news\/local\/jussie-smollett-verdict-what-he-was-found-guilty-of-and-whats-next-in-the-legal-saga\/2704278\/\">according<\/a> to NBC Chicago.<\/p>\n<p>\u201cIf it was me, I would give him a taste of jail time, and sentence him to 1,000 hours of community service in a year,\u201d former Illinois Judge David Erickson <a href=\"https:\/\/nypost.com\/2021\/12\/10\/jussie-smollett-will-likely-get-less-than-a-year-of-jail-legal-experts\/\">told<\/a> the New York Post, adding,&nbsp;\u201cIf it\u2019s jail time, it will be a year or less.\u201d<\/p>\n<p>The expert said the judge will look at Smollett\u2019s \u201cmotivation\u201d in the matter when considering jail time, and a past DUI arrest.<\/p>\n<p>\u201cI think [Cook County] Judge [Linn] Winn will consider that he used racism and homophobia to promote his own career. If you\u2019re going to give someone a harsher sentence, you have to look at his motivation,\u201d Erickson said.&nbsp;\u201cWhy he did it now becomes the question in sentencing especially with a hate crime.\u201d<\/p>\n<p>The Post report noted, \u201cThe judge may also look at a <a href=\"https:\/\/pagesix.com\/2019\/02\/20\/jussie-smollett-once-lied-to-cops-during-dui-arrest\/\" target=\"_blank\" rel=\"noreferrer noopener\">2007 DUI arrest in which Smollett lied to police<\/a> then pleaded no-contest to false impersonation, driving under the influence, and driving without a valid license, Erickson said.\u201d<\/p>\n<p>Another legal expert,&nbsp;Terri Austin, speculated that Judge Winn would make an example out of Smollett.<\/p>\n<p>\u201cI think there is a good likelihood that he will do jail time because he wasted the resources of the city of Chicago,\u201d Austin explained. \u201cHe lied multiple times to police officers and lied on the stand. I think the judge may also try to make an&nbsp;example out of him.\u201d<\/p>\n<p>\u201cAt the end of the day, he\u2019s probably going to get between one and three years, and probation,\u201d she said. \u201cAnd a $25,000 fine.\u201d<\/p>\n<p>Back in January 2019, Smollett claimed he was targeted and attacked by apparent supporters of President Donald Trump in an anti-gay, anti-black hate crime. His alleged attackers, whom he initially described as white males who yelled \u201cThis is MAGA country,\u201d were brothers Abimbola and Olabinjo Osundairo. Notably, the brothers are both black men who knew the \u201cEmpire\u201d star before the incident and have claimed Smollett orchestrated the \u201choax.\u201d <a href=\"https:\/\/www.dailywire.com\/news\/here-are-all-top-democrats-tweets-about-jussie-amanda-prestigiacomo\">The Daily Wire<\/a> detailed Smollett\u2019s claim at the time:<\/p>\n<p><em>Smollett contends he was targeted by two Trump supporters, who verbally and physically accosted him as he was walking home from a Subway sandwich shop in downtown Chicago on January 29.
