This week, Judge Fitzgerald denied the Swift team\u2019s request for summary judgment to have the suit ended in the singer\u2019s favor.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>\n<iframe loading=\"lazy\" title=\"Taylor Swift - Shake It Off\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/nfWlot6h_JM?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/p>\n<p>Representatives for the pop star blasted the lawsuit. \u201cThese men are not the originators, or creators, of the common phrases \u2018players\u2019 or \u2018haters\u2019 or combinations of them. They did not invent these common phrases nor are they the first to use them in a song,\u201d they said.<\/p>\n<p>But the judge just could not agree to find for summary judgment.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>\u201cEven though there are some noticeable differences between the works, there are also significant similarities in word usage and sequence\/structure,\u201d the judge wrote,adding, \u201cthe court cannot presently determine that no reasonable juror could find substantial similarity of lyrical phrasing, word arrangement, or poetic structure between the two works.\u201d<\/p>\n<p>Fitzgerald admitted that Swift\u2019s team made \u201cpersuasive arguments\u201d but insisted that there was just too much evidence both ways to agree to Swift\u2019s demand to end the trial out of hand.<\/p>\n<p>\n<iframe loading=\"lazy\" title=\"3LW - Playas Gon&#039; Play\" width=\"500\" height=\"375\" src=\"https:\/\/www.youtube.com\/embed\/dD9A8x_xn5g?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/p>\n<p>\u201cOur clients are finally moving closer to the justice they so richly deserve,\u201d said Hall\u2019s and Butler\u2019s lawyer Marina Bogorad after the judge\u2019s ruling was released Thursday. \u201cThe opinion\u2026 is especially gratifying to them because it reinforces the idea that their creativity and unique expression cannot be misappropriated without any retribution.\u201d<\/p>\n<p>The date for the trial has not yet been set.<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>This is the second time that Swift\u2019s song \u201cShake It Off\u201d has been taken to court. In 2015, a Los Angeles judge throw out a lawsuit filed by R&amp;B singer Jesse Braham who alleged that Swift\u2019s song was plagiarized from his 2013 song, \u201cHaters gone Hate.\u201d Braham sued for $42 million but lost the case when U.S. District Court Judge Gail Standish <a href=\"https:\/\/www.breitbart.com\/news\/judge-uses-taylor-swifts-lyrics-to-dismiss-copyright-lawsuit\/\" target=\" _blank\" rel=\"noopener\">dismissed<\/a> the suit.<\/p>\n<p>Swift is facing another suit over a different album, as well. Evermore Park, a medieval fantasy attraction near Provo, Utah, filed a lawsuit over the singer\u2019s 2020 album, <i>Evermore<\/i>, claiming that she caused harm to their business with the album title.<\/p>\n<p>The park says that their standing on Google disappeared nearly overnight when her album was released because all searches for \u201cEvermore\u201d stopped sending people to their website and instead sent everyone to information about Swift\u2019s new album.<\/p>\n<div id=\"attachment_19101882\" class=\"wp-caption alignnone\" readability=\"34\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/12\/GettyImages-1352933785.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-19101882\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/12\/GettyImages-1352933785.jpg\" alt=\"NEW YORK, NEW YORK - NOVEMBER 12: Taylor Swift attends the &quot;All Too Well&quot; New York Premiere on November 12, 2021 in New York City. (Dimitrios Kambouris\/Getty Images)<\/em><\/p>\n<\/div>\n<p>Swift has also garnered criticism for her incessant political activism in recent years.<\/p>\n<p>In 2019, the singer officially <a href=\"https:\/\/www.breitbart.com\/entertainment\/2020\/10\/07\/taylor-swift-backs-biden-to-start-the-healing-process-america-desperately-needs\/\" target=\" _blank\" rel=\"noopener\">endorsed<\/a> Joe Biden\u2019s bid for the White House, saying in October of that year that Biden will work to serve the needs of \u201cpeople of color,\u201d women, and the \u201cLGBTQIA+\u201d community. Swift also <a href=\"https:\/\/www.breitbart.com\/entertainment\/2020\/05\/29\/taylor-swift-accuses-trump-of-stoking-white-supremacy-in-woke-twitter-rant\/\" target=\" _blank\" rel=\"noopener\">lashed out<\/a> at President Donald Trump and accused him of \u201cstoking the fires of white supremacy\u201d and warning \u201cwe will vote you out in November.\u201d<\/p>\n<p>This year, Swift appealed to her fans in the Virginia governor\u2019s race in a desperate attempt to get long-time political careerist Terry McAuliffe elected there. According to reports, \u201cSwifties\u201d from out of state began <a href=\"https:\/\/www.breitbart.com\/entertainment\/2021\/11\/03\/report-taylor-swift-fans-changed-voter-registration-to-virginia-in-failed-attempt-to-help-defeated-terry-mcauliffe\/\" target=\" _blank\" rel=\"noopener\">registering<\/a> in Virginia as Democrats to push McAuliffe over the finish line.
