Rather, it is an act of willful disregard of the evidence. It occurs when jurors acquit regardless of the evidence of guilt. It is not that they don\u2019t see or understand the evidence; they simply choose the individual over the evidence.<\/p>\n<p>Lawyers usually cannot expressly ask jurors to disregard the evidence of a case in contradiction to the judge\u2019s instructions. But they can make the case for nullification in not-so-subtle ways.&nbsp;In Smollett\u2019s case, the defendant talked about his mistrust of the police and openly accused the prosecutor of misrepresenting facts to the jury. In front of the jury, he declared:&nbsp;\u201cI\u2019m a&nbsp;Black&nbsp;man in America and I do&nbsp;not&nbsp;trust police.\u201d<\/p>\n<p>Smollett was curt on cross examination, insisting that the two Nigerian brothers (one of whom he said was once his lover), the Chicago police, the prosecutors and others all sought to frame him.&nbsp;<a href=\"https:\/\/www.foxnews.com\/live-news\/jussie-smollett-case\" target=\"_blank\" rel=\"noopener noreferrer\">Smollett even chastised prosecutor Dan Webb<\/a>&nbsp;for&nbsp;reading from Smollett\u2019s Instagram messages, which included the N-word; Smollett told Webb to spell or abbreviate the word so as not to offend \u201cevery African American in this room.\u201d<\/p>\n<p>\u2026<\/p>\n<p>The Smollett defense is a classic plea for nullification, which is why it seems so bizarre to most people weighing the evidence. The trial becomes a struggle over perceptions rather than proof. Even Smollett\u2019s lawyers claimed to be victims in the courtroom. Defense attorney Tamara Walker demanded a mistrial in a sidebar conversation with attorneys from both sides and Cook County Judge James Linn. Walker reportedly broke into tears after accusing the judge of lunging at her in the courtroom and making faces from the bench.<\/p>\n<\/blockquote>\n<p>Turley noted that Smollett and his legal team tried to create drama in the courtroom, raising the familiar complaints of the Black Lives Matter movement, accusing the judge and the prosecution of racism and aggression.<\/p>\n<p>If successful, Smollett will likely still struggle to rebuild his acting career, though he has <a href=\"https:\/\/www.breitbart.com\/entertainment\/2021\/12\/08\/jussie-smollett-already-preparing-hollywood-comeback-as-hate-crime-hoax-trial-draws-to-close\/\">vowed<\/a>&nbsp;to make \u201cthat allow minorities, blacks and gays the opportunity to show their artistry.\u201d<\/p>\n<p><em>Joel B.
