He denied the arson and hurled obscenities at reporters before asking them for a cigarette.<\/p>\n<p>\u201cThe moms that want to rape their f****g daughters \u2014 they set it on fire,\u201d he yelled, according to the <em>Post<\/em>.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Arson is only considered a felony in New York if the arsonist harms or attempts to harm a person, or carries out the attack as a hate crime.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\" readability=\"7.3824884792627\">\n<p lang=\"en\" dir=\"ltr\">Fox News&#8217;s 50-foot-tall Christmas Tree went up in flames in Midtown Manhattan early Wednesday morning and a suspected arsonist was arrested. <a href=\"https:\/\/t.co\/RvlTgLQPdQ\">https:\/\/t.co\/RvlTgLQPdQ<\/a><\/p>\n<p>\u2014 Breitbart News (@BreitbartNews) <a href=\"https:\/\/twitter.com\/BreitbartNews\/status\/1468609033552764935?ref_src=twsrc%5Etfw\">December 8, 2021<\/a><\/p>\n<\/blockquote>\n<p>Bill de Blasio supported the bail <a href=\"https:\/\/www.breitbart.com\/politics\/2019\/11\/18\/new-york-jailbreak-law-to-free-suspects-accused-of-manslaughter-negligent-homicide-child-sex-crimes\/\">reforms<\/a> in 2019 before they came in, saying: \u201cWith the lowest rate of incarceration of any major city, New York City is proving you don\u2019t need to arrest your way to safety.<\/p>\n<p>\u201cWe are taking additional steps to ensure that people who can be safely supervised in the community are able to stay there, all while keeping crime at historic lows.\u201d He called for them to be rolled back just months after they were implemented in 2020, when crime figures spiked.<\/p>\n<p>Assistant District Attorney Matthew Bayley confirmed at the arraignment Tamanaha was \u201cnot charged with a bail eligible offense,\u201d the <em>Daily Mail<\/em> <a href=\"https:\/\/www.dailymail.co.uk\/news\/article-10291447\/Arsonist-accused-torching-Fox-Newss-Christmas-tree-FREED-bail-24-hours-later.html?ito=social-twitter_dailymailus\">reports<\/a>.<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>Judge Martinez Alonso granted Tamanaha a supervised release at the request of prosecutors.<\/p>\n<p>For a judge to set bail, Tamanaha would have to be charged with at least third-degree felony arson, criminal defense lawyer Mark Bederow told FOX News.<\/p>\n<div id=\"attachment_19063898\" class=\"wp-caption alignnone\" readability=\"35\"><a href=\"https:\/\/media.breitbart.com\/media\/2021\/12\/GettyImages-1229822586.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-large wp-image-19063898\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/12\/GettyImages-1229822586-1024x683-1.jpg\" alt width=\"990\" height=\"660\" \/><\/a><\/p>\n<p class=\"wp-caption-text\"><em>Former glory: Nutcracker wearing protective masks are placed in front of the Christmas Tree at News Corporation last year on November 27, 2020 in New York, United States. (Jeenah Moon\/Getty Images)<\/em><\/p>\n<\/div>\n<p>The suspect has a history of destructive stunts, is homeless and abuses drugs, his father told the<em> Post<\/em> earlier Wednesday.<\/p>\n<p>\u201cOh, he\u2019s a nut. I can\u2019t control him,\u201d Richard Tamanaha, of Hawaii, said. \u201cMentally, he\u2019s not all there.\u201d<\/p>\n<p>The now destroyed 50-foot-tall tree&nbsp;<a class=\"x5l\" href=\"https:\/\/www.foxnews.com\/us\/fox-square-christmas-tree-fire-suspect-arrested\" target=\"_blank\" rel=\"noopener external\">boasted<\/a>&nbsp;100,000 lights, 10,000 glass ornaments and took workers 21-hours to assemble, Fox News reports.
