Version: 4.0.47--><p>The Daily Wire has filed an update in its legal challenge to the federal vaccine mandate for private businesses, asking the court not to grant the Occupational Safety and Health Administration\u2019s (OSHA) request to lift the stay on the Biden administration\u2019s COVID-19 vaccine mandate for employers of company\u2019s with 100 or more employees.<\/p>\n<p>If employers of 100 employees&nbsp;<a href=\"https:\/\/www.dailywire.com\/news\/oshas-covid-vaccine-mandate-for-private-employers\" target=\"_blank\" rel=\"noopener\">fail to comply<\/a> with the OSHA mandate, the Biden administration may impose fines of $13,653 per violation \u2014 and $136,532 for \u201c<a href=\"https:\/\/www.osha.gov\/penalties\">willful or repeated<\/a>\u201d violations.<\/p>\n<p>\u201cOSHA\u2019s radical power grab is unconstitutional, not authorized by statute, and fails to satisfy the basic requirements for an ETS,\u201d The Daily Wire\u2019s update noted. \u201cOSHA\u2019s arguments are so outlandish, they can only be understood as post hoc excuses for a general vaccine mandate masquerading as a workplace safety rule.\u201d<\/p>\n<p>In response, The Daily Wire is submitting \u201cthree expert declarations that highlight the inconsistencies and inadequacies of OSHA\u2019s justifications.\u201d<\/p>\n<p>The Justice Department\u2019s request to lift the stay came more than two weeks after the order was originally stayed by the Fifth Circuit.<\/p>\n<p>\u201cBefore the various petitions for review were assigned to this Court, the Fifth Circuit granted a stay and enjoined the implementation and enforcement of the Standard,\u201d the petition states, referring to the OSHA rule. \u201cThe Fifth Circuit\u2019s stay should be lifted immediately.\u201d<\/p>\n<p>The Fifth Circuit&nbsp;<a href=\"https:\/\/www.dailywire.com\/news\/breaking-federal-court-freezes-biden-vaccine-mandate-over-possible-grave-statutory-and-constitutional-issues\">stayed<\/a>&nbsp;the OSHA regulation on November 6, citing \u201cgrave statutory and constitutional issues.\u201d A three-judge panel at the court later&nbsp;<a href=\"https:\/\/www.dailywire.com\/news\/breaking-federal-appeals-court-blocks-bidens-staggeringly-overboard-vaccine-mandate\">wrote<\/a>&nbsp;that the regulation \u201cgrossly exceeds OSHA\u2019s statutory authority.\u201d<\/p>\n<p>In a <a href=\"https:\/\/www.dailywire.com\/news\/breaking-the-daily-wire-challenges-biden-administration-vaccine-mandate\" target=\"_blank\" rel=\"noopener\">press release<\/a> accompanying the original lawsuit, The Daily Wire stated, \u201cThe mandate is unconstitutional because the Constitution does not grant Congress \u2014 much less OSHA \u2014 the general police powers needed to mandate vaccination and virus testing as a condition of private employment, or to deputize employers to enforce that mandate on its behalf.\u201d<\/p>\n<p>The Daily Wire was the first organization to&nbsp;<a href=\"https:\/\/www.dailywire.com\/news\/breaking-the-daily-wire-challenges-biden-administration-vaccine-mandate\">challenge<\/a> the rule in the 6th Circuit Court of Appeals. They filed the legal challenge against the Biden administration on November 4, hours after OSHA published roughly 500-pages worth of regulations and standards explaining the rule.<\/em><\/p>\n<p><em>The rule mandated all companies with 100 employees or more require their workers to either be vaccinated or submit to regular COVID-19 testing.
