Mike Braun, passed 52-48 with the support of Democratic Sens. Joe Manchin of West Virginia and Jon Tester of Montana. It passed under the Congressional Review Act, a law that empowers the minority party in the Senate to force a vote of disapproval on a federal rule.<\/p>\n<p>\u201cI\u2019m not crazy about mandates,\u201d Tester <a href=\"https:\/\/twitter.com\/frankthorp\/status\/1468308133453963268\">told reporters<\/a> Tuesday.<\/p>\n<p>The vote is similar to one forced Thursday by Utah Republican Sen. Mike Lee. Democrats <a href=\"https:\/\/dailycaller.com\/2021\/12\/02\/house-passes-short-term-funding-bill-with-shutdown-one-day-away\/\" target=\"_blank\" rel=\"noopener noreferrer\">unanimously voted against it<\/a>, however, arguing that adopting it would have forced a costly government shutdown. That vote came days after a federal court <a href=\"https:\/\/dailycaller.com\/2021\/11\/06\/fifth-circuit-federal-court-temporarily-blocks-bidens-vaccine-mandate\/\" target=\"_blank\" rel=\"noopener noreferrer\">blocked<\/a> the mandate from going into effect, which led to the Occupational Safety and Health Administration ultimately <a href=\"https:\/\/dailycaller.com\/2021\/11\/17\/osha-suspends-implementation-enforcement-joe-biden-private-business-vaccine-rule-court-order\/\" target=\"_blank\" rel=\"noopener noreferrer\">suspending<\/a> its implementation.<\/p>\n<p>Ahead of Wednesday\u2019s vote, Lee said that senators had a duty to \u201cassert clearly, unambiguously and swiftly that these mandates are unconstitutional, illegal and morally in defensible.\u201d <strong><a href=\"https:\/\/dailycaller.com\/2021\/12\/01\/republican-objections-to-bidens-vaccine-mandate-could-force-weeklong-government-shutdown-chuck-schumer\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Republican Objections To Biden\u2019s Vaccine Mandate Could Force Weeklong Government Shutdown)<\/a><\/strong><\/p>\n<div id=\"attachment_7333841\" class=\"wp-caption alignnone\" readability=\"32\">\n<p id=\"caption-attachment-7333841\" class=\"wp-caption-text\">Sen. (BRENDAN SMIALOWSKI\/AFP via Getty Images)<\/p>\n<\/div>\n<p>Democrats, however, criticized the resolution as dangerous and warned that it would undermine the fight against the pandemic. \u201cHow on earth does it make sense right now to undercut one of the strongest tools we have to get people vaccinated and stop this virus?\u201d said Washington Democratic Sen. Patty Murray before the vote.<\/p>\n<p>While the measure passed the Senate, it would be unlikely to pass a Democratic House. If it did, it would almost certainly be met with a presidential veto.<\/p>\n<p>As news of the coming vote broke Tuesday, White House Press Secretary Jen Psaki <a href=\"https:\/\/www.c-span.org\/video\/?516575-1\/white-house-briefs-president-bidens-virtual-meeting-russian-leader\">confirmed<\/a> that Biden would veto it if it made it to his desk, calling the administration\u2019s position \u201creasonable.\u201d<\/p>\n<p>\u201cOur view and the view of many Americans is that if people aren\u2019t vaccinated, having them test once a week is quite reasonable as we\u2019re thinking about how to protect our workplaces, how to protect stores and retail locations as people are out shopping for Christmas and the holidays, how to protect schools and public places,\u201d Psaki said. \u201cAnd we also know that more than 100 leading public health experts have endorsed this rule.\u201d<\/p>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
