Makin<\/em>, which tests a Maine law that provides subsidies for parents to send children to school, except \u201csectarian\u201d schools.<\/p>\n<p>The existing <a href=\"https:\/\/www.mainelegislature.org\/legis\/statutes\/20-a\/title20-Asec2951.html\">law<\/a> provides that the subsidy can only be used for tuition in a school if that school is \u201ca nonsectarian school in accordance with the First Amendment of the United States Constitution.\u201d<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>During oral argument, the justices questioned Chief Deputy Attorney General <a href=\"https:\/\/www.maine.gov\/ag\/about\/division_chief_bios.shtml?id=2734266\">Christopher Taub<\/a>&nbsp;about the meaning of the word \u201csectarian\u201d (as opposed to \u201creligious\u201d) and about whether there were any other restrictions on the use of state funding to provide subsidies or vouchers to hypothetical schools.<\/p>\n<p>Taub argued the law should be upheld because the state government of Maine is allowed to promote \u201creligious neutrality.\u201d Alito questioned that premise, and asked whether the state could fund a school that \u201cinculcates a purely materialistic view of life. Taub admitted: \u201cNow it\u2019s possible that, you know, down&nbsp;the road some school might pop up that is&nbsp;teaching something else, not religion but&nbsp;something else, say, Marxism or Leninism or, you&nbsp;know, white supremacy. Clearly, those kinds of&nbsp;schools would be doing something completely&nbsp;inconsistent with a public education.\u201d<\/p>\n<p>Taub also admitted that the current law would not prevent such schools from being funded, but that \u201cif a white supremacy school tried to participate&nbsp;in Maine\u2019s program, the legislature would&nbsp;swiftly act to say, no, you know, beyond being&nbsp;religiously neutral, you also can\u2019t teach&nbsp;principles of \u2014 of \u2014 of hatred.\u201d<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Alito then asked whether a school that taught religious tolerance would be ineligible, since it was a belief that involved religion. Justice Elena Kagan then asked whether Taub was confident that a school that taught white supremacy would never be funded; Taub reiterated that he was certain the legislature would act in that situation.<\/p>\n<p>The following exchange then took place:<\/p>\n<blockquote readability=\"13\">\n<p><strong>JUSTICE ALITO:<\/strong> Would you say the same thing about a school that teaches critical race theory?<br \/><strong>MR. TAUB:<\/strong> Whether that school would be eligible?<br \/><strong>JUSTICE ALITO:<\/strong> Yeah.<br \/><strong>MR. TAUB:<\/strong> So I think that that is something that the legislature would have to look at. I mean, that one\u2019s closer because, frankly, I don\u2019t \u2014 I don\u2019t really know exactly what it means to teach critical race theory. So I think \u2014 I think the Maine legislature would have to look at what that actually means.&nbsp;But \u2014 but I \u2014 I will say this, that \u2014 that if \u2014 that \u2014 that if teaching critical race theory is \u2014 is \u2014 is antithetical to a public education, then the legislature would likely address that.<\/p>\n<\/blockquote>\n<p>As Breitbart News has <a href=\"https:\/\/www.breitbart.com\/politics\/2020\/09\/06\/pollak-eight-years-later-andrew-breitbart-vindicated-on-critical-race-theory\/\">explained<\/a> for nearly a decade, Critical Race Theory is the belief that race is fundamental to American society, and that white supremacy is deeply ingrained in American institutions, including the Constitution. As such, efforts to establish legal racial equality cannot possibly eliminate racism.<\/p>\n<p>Only transforming American society itself, possibly through the addition of socioeconomic rights to the Constitution, can the U.S. redeem itself from the original sin of white supremacy.<\/p>\n<p>The <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/20\/20-1088\/168134\/20210204140045165_Petition%20for%20Writ%20of%20Certiorari.pdf\">plaintiffs<\/a> are a pair of parents in Maine, as their petition to the Supreme Court explained:<\/p>\n<blockquote readability=\"11\">\n<p>Both families live in a school district that neither operates a public secondary school nor contracts with a particular secondary school for the education of its resident secondary students. Accordingly, the Carsons and Nelsons are entitled to the tuition assistance benefit. Because of the sectarian exclusion, however, neither family can use the benefit at the school they believe is best for their child.<\/p>\n<\/blockquote>\n<p>The First Circuit upheld Maine\u2019s law.<\/p>\n<p>The case is&nbsp;<em>Caron v. Makin<\/em>, Docket No.&nbsp;20-1088.<\/p>\n<p><em>Joel B.
