That\u2019s why I haven\u2019t proposed a mandate at the state level. Some states have. We have not, we\u2019re waiting to see what happens in court.\u201d<\/p>\n<p>\u201cBut we have a lot of the same concerns that you just voiced, and it\u2019s going to be a problem for all of us,\u201d she added.<\/p>\n<p>Whitmer\u2019s remarks were in response to a question asked by the head of a home health care organization in the area, the <a href=\"https:\/\/www.freep.com\/story\/news\/local\/michigan\/2021\/12\/07\/gretchen-whitmer-joe-biden-covid-19-vaccine-mandate\/6423638001\/\">Detroit Free Press<\/a> noted.<\/p>\n<p>Whitmer has been mostly quiet on the talk of vaccine mandates, the Detroit Free Press added.<\/p>\n<p>The outlet also reported that Michigan is one of more than two dozen states that, despite having its own set of workplace safety regulations, are required to have state and local officials meet guidelines that effectively mirror federal guidelines, meaning the mandate would apply in essence.<\/p>\n<p>The Biden administration\u2019s vaccine mandate for <a href=\"https:\/\/www.dailywire.com\/news\/judge-halts-biden-vaccine-mandate-for-federal-contractors\">federal employees<\/a> was halted nationwide by a federal court in Georgia on Tuesday. The decision followed a preliminary injunction brought by a federal judge in Kentucky.<\/p>\n<p>The Occupational Safety and Health Administration (OSHA) <a href=\"https:\/\/www.dailywire.com\/news\/osha-suspends-its-vaccine-mandate-what-that-means-and-whats-next\">suspended enforcement<\/a> of the vaccine mandate for private employers after it was halted by injunctions from the Fifth Circuit Court of Appeals. The Court found that the mandate was \u201cstaggeringly overbroad\u201d and legally dubious for multiple reasons. <a href=\"https:\/\/www.dailywire.com\/news\/psaki-businesses-should-move-forward-with-covid-19-measures-despite-two-court-stays\">The Daily Wire<\/a> reported:<\/p>\n<p>The Fifth Circuit Court issued a&nbsp;<a href=\"https:\/\/www.dailywire.com\/news\/breaking-federal-court-freezes-biden-vaccine-mandate-over-possible-grave-statutory-and-constitutional-issues\">preliminary injunction<\/a>&nbsp;temporarily halting the mandate, pending judicial review, on November 6, citing potential \u201cgrave statutory and constitutional issues with the Mandate.\u201d The Court reaffirmed its stay after completing its judicial review on November 12,&nbsp;<a href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/21\/21-60845-CV0.pdf\">writing<\/a>&nbsp;that the mandate was both over-inclusive, because of its sweeping and indiscriminate imposition on companies regardless of industry or work environment, and under-inclusive because it purports to help workers with 99 or more coworkers while giving no help to those with 98 or fewer coworkers. Besides that, the Court found the administration\u2019s stated impetus \u2014 an emergency that has gone on for almost two years and that OSHA took two months to respond to \u2014 dubious. The Court found that the mandate, which the Court described as \u201cstaggeringly overbroad,\u201d \u201cgrossly exceeds OSHA\u2019s statutory authority.\u201d<\/p>\n<p>The mandate is currently being reviewed by the Sixth Circuit Court of Appeals.<\/p>\n<p>A group of Republicans in the U.S. Senate has also moved to block the OSHA mandate.
