class=\"subheading\">A federal judge Tuesday <a href=\"https:\/\/www.scag.gov\/media\/1pfaybfp\/federal-contractor-order.pdf\">issued<\/a> an injunction striking down the Biden administration\u2019s coronavirus vaccine mandate for federal contractors, saying the plaintiffs are \u201clikely [to]&nbsp;succeed in their claim that the President exceeded the authorization given to him by Congress.\u201d<\/p>\n<p>The lawsuit was brought by&nbsp;Attorney General Alan Wilson and Governor Henry McMaster of South Carolina, along with the attorneys general of Georgia, Alabama, Idaho, Kansas, Utah, and West Virginia and the governors of Georgia, Alabama, and Idaho, as well as other state entities.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>The case revolves around the president\u2019s authority under the Federal Property and Administrative Services Act (Procurement Act) and the authority it gives the president to issue public health mandates such as the one President Joe Biden issues in Executive Order (EO) 14042 to require all federal contractors to be vaccinated or face possible termination.<\/p>\n<div class>\n<div class=\"WordSection1\">\n<div id=\"SafeStyles1638914760\" class readability=\"8.5\">\n<div class readability=\"12\">\n<p class><span class>\u201cThe Court acknowledges the tragic toll that the COVID-19 pandemic has wrought throughout the nation and the globe,\u201d Judge Stan Baker begins. \u201cHowever, even in time of crisis this Court must preserve the rule of law and ensure that all branches of government act within the bounds of their constitutionally granted authorities.\u201d<\/span><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>Furthermore, writes Baker, the government\u2019s&nbsp;\u201c\u2018strong interest in combating the spread of [COVID-19]\u2019 \u2026 does not permit the government to \u2018act unlawfully even in the pursuit of desirable ends.&#8217;\u201d<\/p>\n<p>Quoting legal precedent, Baker explains that the Procurement Act:<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<blockquote readability=\"8\">\n<p>Grants the President particularly direct and broad-ranging authority over those larger administrative and management issues that involve the Government as a whole.&nbsp;And that direct presidential authority should be used in order to achieve a flexible management system capable of making sophisticated judgements in pursuit of economy and efficiency.<\/p>\n<\/blockquote>\n<p>The judge issued a preliminary injunction on the mandate during the lawsuit\u2019s pathway through the court system, concluding that the president exceeded his authority to issue such an EO.<\/p>\n<p>Baker writes:<\/p>\n<blockquote readability=\"9\">\n<p>The direct impact of EO 14042 goes beyond the administration and management of procurement and contracting; in its practical application (requiring a significant number of individuals across the country working in a broad range of positions and in numerous different industries to be vaccinated of face serious risk of losing their job), it operates as a regulation of public health.<\/p>\n<\/blockquote>\n<p>\u201cIt will also have a major impact on the economy at large, as it limits contractors\u2019 and members of the workforce\u2019s ability to perform work on federal contracts,\u201d Baker concluded. \u201cAccordingly, it appears to have vast economic and political significance.\u201d<\/p>\n<p>The judge concluded that the Plaintiffs have shown a sufficient likelihood that the EO \u201cbrings about an enormous and transformative expansion in \u2026 regulatory authority without clear congressional authorization,\u201d referencing a Supreme Court requirement that Congress must \u201c\u2018speak clearly\u2019 when authorizing the exercise of powers of \u2018vast economic and political significance.&#8217;\u201d<\/p>\n<p>While Baker noted that courts typically afford the president deference when adjudicating his authority under the Procurement Act, he points out that \u201cdeference was expressly <em>not<\/em> intended to operate as \u2018a blank check for the President to fill in at his will.&#8217;\u201d [Emphasis in original].<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>Baker also pointed out that&nbsp;the Biden administration has neither cited a case that allows the president \u201cto promulgate such a wide and sweeping public health regulation,\u201d nor cited a case in which a court upheld an analogous action.<\/p>\n<p>Concluding his determination of the merits, Baker explained that if the Biden administration were to have success in this case, it would give the president the \u201cright to impose virtually any kind of requirement on businesses that wish to contract with the Government.\u201d<\/p>\n<p>\u201cFollowing the Defendants\u2019 logic and reason,\u201d the judge writes, \u201cthe Procurement Act would be construed to give the President the right to impose virtually any kind of requirement on businesses that wish to contract with the Government \u2026 so long as he determines it could lead to a healthier and thus more efficient workforce or it could reduce absenteeism.\u201d<\/p>\n<p>In a press release regarding Baker\u2019s issuance of the injunction, Wilson <a href=\"https:\/\/www.scag.gov\/about-the-office\/news\/judge-blocks-vaccine-requirement-for-federal-contractors\/\">said,<\/a>&nbsp;\u201cAbuse of power by the Biden administration has been stopped cold again. The rule of law has prevailed and liberty is protected. When the President oversteps his authority the law is thankfully there to halt his misuse of power.\u201d<\/p>\n<p>The case is <em>Georgia v.
