When Republican Gov. Kristi Noem attempted to enforce the legislation in 2021, Planned Parenthood sued again. A federal judge <a href=\"https:\/\/apnews.com\/article\/health-lawsuits-abortion-south-dakota-sd-state-wire-d1f45c3d373166f95d42a559538cb6ca\">ruled<\/a> in August that the law is likely to \u201cinfringe on women\u2019s right to free speech secured in the First Amendment, and it presents an undue burden on a woman\u2019s right to access abortion.\u201d<\/p>\n<p>Noem is hoping that the Supreme Court\u2019s prospective <a href=\"https:\/\/dailycaller.com\/2021\/12\/01\/supreme-court-hears-oral-arguments-in-case-challenging-roe-v-wade\/\">ruling<\/a> in <em>Dobbs v. Jackson Women\u2019s Health Organization <\/em>will lead a circuit court to allow the law to go into effect. <strong><a href=\"https:\/\/dailycaller.com\/2021\/11\/17\/scientific-advancements-abortion-supreme-court-roe-wade-dobbs-jackson\/\">(RELATED: Scientific Advancements At Center Stage In Major Supreme Court Abortion Case)<\/a><\/strong><\/p>\n<p>\u201cFollowing last week\u2019s historic oral arguments in the <i>Dobbs<\/i> case, South Dakota is moving forward with our legal fight to protect unborn lives,\u201d she told the Daily Caller. \u201cI look forward to the day when all life \u2013 born and unborn \u2013 is protected by law, and this litigation will be helpful in achieving that ultimate goal.\u201d<\/p>\n<p>South Dakota filed its appeal on Dec. 3, and has hired the law firm of conservative attorney Jay Sekulow to represent the state.
