It is actually due to <a href=\"https:\/\/www.law.cornell.edu\/rules\/frcrmp\/rule_53\" target=\"_blank\" rel=\"noopener noreferrer\">Federal Rule of Criminal Procedure 53<\/a>, which prohibits the broadcasting of criminal proceedings from federal courtrooms.<\/p>\n<p><span><strong>Fact Check:&nbsp;<\/strong><\/span><\/p>\n<p>The <a href=\"https:\/\/www.facebook.com\/photo.php?fbid=241411351416396&amp;set=a.107352638155602&amp;type=3&amp;theater\" target=\"_blank\" rel=\"noopener noreferrer\">viral meme<\/a> attempts to make a comparison in coverage between the trials of <a href=\"https:\/\/www.cnn.com\/2021\/11\/29\/us\/ghislaine-maxwell-epstein-profile-intl\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\">Maxwell<\/a>, the ex-girlfriend and confidant of deceased convicted sex offender Jeffrey Epstein, and Kyle Rittenhouse, the 18-year-old found <a href=\"https:\/\/www.youtube.com\/watch?v=W6m-uAFZ6Ys\" target=\"_blank\" rel=\"noopener noreferrer\">not guilty<\/a> last month of charges filed against him in connection to the <a href=\"https:\/\/www.nytimes.com\/2020\/08\/27\/us\/kyle-rittenhouse-kenosha-shooting-video.html\" target=\"_blank\" rel=\"noopener noreferrer\">Aug. 25, 2020, shootings<\/a> during a Kenosha, Wisconsin, protest. Maxwell\u2019s trial for federal sex trafficking charges, to which she has pleaded not guilty, started on Nov. 29, according to <a href=\"https:\/\/www.nytimes.com\/live\/2021\/11\/29\/nyregion\/ghislaine-maxwell-trial\" target=\"_blank\" rel=\"noopener noreferrer\">The New York Times<\/a>.<\/p>\n<p>\u201cGhislaine Maxwells (<em>sic<\/em>) trial should be televised, like Kyle\u2019s was. Why isn\u2019t it?\u201d reads text inside the meme. \u201cBecause too many politicians and pedo-elites are involved.\u201d <strong><a href=\"https:\/\/checkyourfact.com\/2021\/11\/30\/fact-check-telephone-number-access-code-audio-ghislaine-maxwell-trial\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Does This Telephone Number And Access Code Allow People To Remotely Listen To Ghislaine Maxwell\u2019s Trial?)<\/a><\/strong><\/p>\n<p>While Maxwell\u2019s federal trial is <a href=\"https:\/\/www.justice.gov\/usao-sdny\/united-states-v-ghislaine-maxwell\" target=\"_blank\" rel=\"noopener noreferrer\">not being televised<\/a>, that is actually due to a long-standing rule pertaining to coverage of federal court proceedings. Federal Rule of Criminal Procedure 53 states, \u201cExcept as otherwise provided by a statute or these rules, the court must not permit the taking of photographs in the courtroom during judicial proceedings or the broadcasting of judicial proceedings from the courtroom,\u201d according to <a href=\"https:\/\/www.law.cornell.edu\/rules\/frcrmp\/rule_53\" target=\"_blank\" rel=\"noopener noreferrer\">Cornell Law School\u2019s Legal Information Institute<\/a>.<\/p>\n<p>On the other hand, Rittenhouse\u2019s case was <a href=\"https:\/\/www.jsonline.com\/story\/news\/crime\/2021\/11\/16\/kyle-rittenhouse-trial-live-updates-from-kenosha\/8637377002\/\" target=\"_blank\" rel=\"noopener noreferrer\">tried<\/a> in a Wisconsin state court. Cameras and audio recording devices are <a href=\"https:\/\/www.wicourts.gov\/sc\/scrule\/DisplayDocument.pdf?content=pdf&amp;seqNo=243103\" target=\"_blank\" rel=\"noopener noreferrer\">largely allowed<\/a> in Wisconsin court proceedings, with the Wisconsin Supreme Court also keeping an <a href=\"https:\/\/www.wicourts.gov\/opinions\/soralarguments.htm\" target=\"_blank\" rel=\"noopener noreferrer\">audio archive<\/a> of oral arguments since 1997, according to the <a href=\"https:\/\/www.rtdna.org\/content\/cameras_tx_wy\" target=\"_blank\" rel=\"noopener noreferrer\">Radio Television Digital News Association<\/a>.<\/p>\n<p><a href=\"https:\/\/cla.umn.edu\/about\/directory\/profile\/kirtl001\" target=\"_blank\" rel=\"noopener noreferrer\">Jane Kirtley<\/a>, the director of the Silha Center for the Study of Media Ethics and Law at the University of Minnesota, told Check Your Fact in an email that \u201ccameras are not permitted in federal trial courts.\u201d<\/p>\n<p>\u201cElectronic media coverage of criminal proceedings in federal courts has been expressly prohibited under Federal Rule of Criminal Procedure 53 since the criminal rules were adopted in 1946,\u201d Kirtley said.
