Bannon in his legal fight against the Department of Justice (DOJ), which is trying to prevent him from releasing documents about the January 6 Capitol riot.<\/p>\n<p>Ironically, the DOJ is trying to suppress documents while prosecuting Bannon for contempt of Congress, a misdemeanor, after he refused to provide documents to the Democrat-dominated U.S. House committee investigating the riot.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>Bannon\u2019s lawyers sought and obtained over 1,000 pages documents from the DOJ that could be necessary to his defense. But the DOJ wants to stop him from releasing them, <a href=\"https:\/\/www.nytimes.com\/2021\/12\/02\/business\/media\/bannon-legal-fight-first-amendment.html?smtyp=cur&amp;smid=tw-nytimes\">claiming<\/a> that he only wants to do so \u201cto make extrajudicial arguments about the merits of the case pending against him and the validity of the government\u2019s decision to seek an indictment.\u201d<\/p>\n<p>In response, <a href=\"https:\/\/www.dailymail.co.uk\/news\/article-10259683\/Media-coalition-files-legal-brief-JOINING-Bannons-fight-against-DOJ-protective-order.html\">according<\/a> to the UK&nbsp;<em>Daily Mail<\/em>, a consortium of media organizations has filed a motion to intervene in the case \u2014 that is, to join as a litigant \u2014 and to stop the court from suppressing \u201cmore than 1,000 pages of witness testimony, grand jury material, and even emails from staff for the House Jan. 6th Committee investigating the Capitol riot\u201d from public view. (Photo by Anna Moneymaker\/Getty Images)<\/em><\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<\/div>\n<p>The&nbsp;<em>Daily Mail<\/em> notes wryly: \u201cThe filing puts the mainstream press squarely on the side of Bannon, who has in the past \u2026 attacked the media as the \u2018opposition party\u2019.\u201d<\/p>\n<p>Bannon is the only person prosecuted by the DOJ in recent years for contempt of Congress. The DOJ declined to prosecute disgraced IRS official Lois Lerner, who targeted conservative groups; as well as former Attorney General Eric Holder, who withheld documents related to the Obama administration\u2019s Operation Fast and Furious, which led to the <a href=\"https:\/\/www.breitbart.com\/border\/2017\/06\/24\/atf-whistleblower-obamas-doj-obstructed-justice-fast-furious-investigation\/\">death<\/a> of U.S. Border Patrol Agent Brian Terry.<\/p>\n<p>After his arrest, Bannon, a former executive chairman of Breitbart News, <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/11\/17\/report-steve-bannon-to-plead-not-guilty-to-criminal-contempt-charges\/\">promised<\/a> that he would go on the offensive against the DOJ over his prosecution, vowing to make it the \u201cmisdemeanor from hell.\u201d<\/p>\n<p>Attorney General Merrick Garland was confirmed amid promises, both by himself and President Joe Biden, that he would not let the Department of Justice (DOJ) become politicized.<\/p>\n<p>In his February confirmation hearing, he said: \u201cThe department \u2026 if I am confirmed, will be under my protection for the purpose of preventing any kind of partisan or other improper motive in making any kind of investigation or prosecution. That\u2019s my vow; that\u2019s the only reason I\u2019m willing to do this job.\u201d<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p><span class=\"video-src-attr\">C-SPAN<\/span><\/p>\n<p>Since then, Garland has sued Republican-governed states over ballot integrity laws; called on federal law enforcement to monitor parents who spoke out at school board meetings, after the National School Board Association <a href=\"https:\/\/www.foxnews.com\/politics\/nsba-coordinated-with-white-house-doj-before-sending-notorious-domestic-terrorists-letter-emails\">collaborated<\/a> with the White House on a letter to him; and indicted Bannon after Biden himself <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/10\/15\/joe-biden-wants-justice-department-to-prosecute-trump-loyalists-defying-congressional-subpoenas\/\">pressured<\/a> the DOJ to prosecute.<\/p>\n<p>It is unlawful to defy a legitimate subpoena under ordinary circumstances. But Bannon\u2019s lawyers have argued that what the&nbsp;United States House Select Committee on the January 6 Attack is seeking is covered by executive privilege, and that he cannot comply without further judicial determinations.<\/p>\n<p>The committee ignored the judicial process and voted to hold Bannon in contempt anyway \u2014 just as the House impeached Trump, the first time, for the \u201chigh crime\u201d of defending the prerogatives of the executive branch in the courts.<\/p>\n<p>Speaker of the House Nancy Pelosi (D-CA) rejected the Republican leadership\u2019s nominees to serve on the committee, appointing two anti-Trump Republicans, Reps. Liz Cheney (R-WY) and Adam Kinzinger (R-IL), instead.<\/p>\n<p><em>Joel B.
