Many states, some states would be able to do that, even if you prevail, under your view, is that correct?\u201d Kavanaugh continued.<\/p>\n<p>\u201cThat\u2019s consistent with our view, Your Honor,\u201d Stewart replied. \u201cIt\u2019s one that allows all interests to have full voice, and many of the abortions we see, in certain states, that I don\u2019t think anybody would think would be moving to change their laws in a more restrictive direction.\u201d<\/p>\n<p>In a later exchange with Julie Rikelman, senior director of Center for Reproductive Rights, Kavanaugh explained what he saw as \u201ca big picture level\u201d of her opponents\u2019 argument, that \u201cthe core problem here is that the Court has been forced, by the position you\u2019re taking \u2026 to pick sides on the most contentious social debate in American life.\u201d<\/p>\n<p>Kavanaugh added, asking her to respond to his overview:<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<blockquote readability=\"13\">\n<p>And to do so in a situation where they say that the Constitution is neutral on the question of abortion, the texts in history, that the Constitution is neither pro-life nor pro-choice on the question of abortion, and they would say, therefore, it should be left to the people to the States or to Congress.<\/p>\n<\/blockquote>\n<p>Rikelman replied the Court rejected those arguments in <em>Planned Parenthood v. Casey<\/em> in 1992, stating this \u201cphilosophical disagreement can\u2019t be resolved in a way that a woman has \u2026 choice in the matter.\u201d<\/p>\n<p>Arguing further that leaving the question of abortion to the people would not be \u201ca neutral position,\u201d Rikelman continued, \u201cThe Constitution provides a guarantee of liberty.\u201d<\/p>\n<p>\u201cThe Court has interpreted that liberty to include the ability to make decisions related to childbearing, marriage, and family, women have an equal right to liberty under the Constitution, Your Honor,\u201d she added.<\/p>\n<p>\u201cAnd if they\u2019re not able to make this decision, if states can take control of women\u2019s bodies and force them to endure months of pregnancy and childbirth, then they will never have equal status under the Constitution,\u201d Rikelman stated.<\/p>\n<p>The case is&nbsp;<em>Dobbs v.
