Ron DeSantis\u2019s (R) gambling expansion compact with the Seminole Tribe earlier this week over concerns of gaming monopolization.<\/p>\n<p>Though the judge&nbsp;<a href=\"https:\/\/s3.documentcloud.org\/documents\/21116740\/florida-gambling-compact-opinion.pdf\">struck<\/a>&nbsp;down the compact, the ruling is being appealed by the Seminole Tribe. The tribe has also not shut off its statewide gambling app, the matter in question.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p class=\"spaced spaced-xl spaced-top spaced-bottom abdp-headline \">The gambling expansion was ruled to violate the&nbsp;federal Indian Gaming Regulatory Act (IGRA) because gambling may only take place on tribal lands. The&nbsp;gambling expansion permitted individuals to place bets located anywhere in the state on an app.<\/p>\n<p class=\"spaced spaced-xl spaced-top spaced-bottom abdp-headline \">The state of Florida argued the expansion was legal because the app\u2019s servers were on tribal land. But the judge dismissed the argument as \u201cfiction.\u201d<\/p>\n<p class=\" \">\u201cWhen a federal statute authorizes an activity only at specific locations, parties may not evade that limitation by \u2018deeming\u2019 their activity to occur where it, as a factual matter, does not,\u201d the judge wrote.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p class=\" \">\u201cAccordingly, because the Compact allows patrons to wager throughout Florida, including at locations that are not Indian lands, the Compact violates IGRA\u2019s \u2018Indian lands\u2019 requirement,\u201d Friedrich added.<\/p>\n<p class=\" \">The ruling does not prohibit the state from entering into another compact with the tribe.<\/p>\n<p class=\" \">\u201cThe State and the Tribe may agree to a new compact, with the Secretary\u2019s approval, that allows online gaming solely on Indian lands,\u201d&nbsp;Friedrich wrote in her opinion. \u201cAlternatively, Florida citizens may authorize such betting across their State through a citizens\u2019 initiative.\u201d<\/p>\n<p class=\" \">In 2018, Florida residents <a href=\"https:\/\/www.politico.com\/newsletters\/florida-playbook\/2021\/11\/23\/tapped-out-judge-spikes-desantis-gambling-plan-495197\">voted<\/a> to amend the Florida constitution, stipulating that \u201cvoters must approve any future expansions of casino gambling.\u201d The amendment was supported by the Seminole Tribe and Disney.<\/p>\n<p class=\" \">\u201cThe GOP-controlled Legislature and DeSantis sidestepped that amendment by insisting the new compact was legal because the actual processing of bets occurred on tribal lands even though someone could use a mobile app anywhere in the state,\u201d <em>Politico<\/em> reported.<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p class=\" \">Advocates for the compact believe the betting app will continue to be operational while the appeal is pending.<\/p>\n<p class=\" \">Nova Southeastern University law professor Bob Jarvis told the Sun the tribe will likely ask for a stay on&nbsp;Friedrich\u2019s ruling, which would permit the tribe to continue its gaming service throughout the state. \u201cOne of the things they will ask is that judge Friedrich\u2019s decision be stayed while the appeal is going forward,\u201d Jarvis said. \u201cI have no doubt that that request will be granted.\u201d<\/p>\n<p class=\" \">Opponents of the compact, however, suggest the continued operation of the app is legally unsound.<\/p>\n<div class=\"crd clln--it\" data-type=\"text\" readability=\"15.578947368421\">\n<div class=\" crd--cnt \" readability=\"26.289473684211\">\n<p class=\" \">\u201cWhatever limited upside the Seminole Tribe thinks they\u2019re garnering here in terms of revenues, they are playing with fire by flagrantly ignoring a court order and potentially violating a number of different federal gambling statutes,\u201d&nbsp;gaming-industry analyst Attorney Daniel Wallach told the Sun.<\/p>\n<p class=\" \">The continuation of the app\u2019s functionality before a stay is presumably grated brings into question the tribes payments the state of Florida was&nbsp;scheduled to receive from the compact, \u201ca 30-year agreement that was supposed to pay Florida $2.5 billion in the first five years and $6 billion by 2030,\u201d the <em>Sun-Sentinel<\/em> <a href=\"https:\/\/www.sun-sentinel.com\/news\/florida\/fl-ne-sports-betting-florida-seminole-20211123-krckfaza3fbjre5x3e6vydijzu-story.html\">reported<\/a>.<\/p>\n<p>In October the tribe submitted its first payment of $37 million.<\/p>\n<p>The case is <em>West Flagler Associates v.
