We certainly see that as a positive sign,\u201d she concluded, adding that the White House is still operating on the same enforcement timeline, and that the administration is \u201cconfident in OSHA\u2019s authority\u201d to impose the mandate.<\/p>\n<p>Psaki\u2019s comments echoed the ones made by Deputy Press Secretary Karine Jean-Pierre after the mandate was <a href=\"https:\/\/www.dailywire.com\/news\/biden-admin-tells-businesses-to-implement-vaccine-mandate-despite-federal-court-halting-mandate\">stayed initially<\/a>. \u201cPeople should not wait,\u201d Jean-Pierre said at the time. \u201cDo not wait to take actions that will keep your workplace safe. It is important and critical to do, and waiting to get more people vaccinated will lead to more outbreaks and sickness.\u201d<\/p>\n<p>The Fifth Circuit Court issued a <a href=\"https:\/\/www.dailywire.com\/news\/breaking-federal-court-freezes-biden-vaccine-mandate-over-possible-grave-statutory-and-constitutional-issues\">preliminary injunction<\/a> temporarily halting the mandate, pending judicial review, on November 6, citing potential \u201cgrave statutory and constitutional issues with the Mandate.\u201d The Court reaffirmed its stay after completing its judicial review on November 12, <a href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/21\/21-60845-CV0.pdf\">writing<\/a> that the mandate was both over-inclusive, because of its sweeping and indiscriminate imposition on companies regardless of industry or work environment, and under-inclusive because it purports to help workers with 99 or more coworkers while giving no help to those with 98 or fewer coworkers. The Court found that the mandate, which the Court described as \u201cstaggeringly overbroad,\u201d \u201cgrossly exceeds OSHA\u2019s statutory authority.\u201dDaily Wire co-CEO Jeremy Boreing celebrated the ruling and encouraged businesses to stop enforcing the mandate. \u201cThis victory won\u2019t mean anything to American workers unless businesses nationwide also stop enforcing and implementing the mandate,\u201d Boreing said.\u201cUnless you\u2019re a government contractor or subject to the health care worker vax requirement or some local or state policy, none of that is in play at the moment. Until the Sixth Circuit or Supreme Court rules otherwise, the OSHA mandate is off. No vaccine requirement. No testing requirement. No masks. No fines. Nothing. You don\u2019t have to do anything.\u201d\u201cIf you\u2019re a business that believes in freedom, the best way you can help is just to stop. Stop implementing OSHA\u2019s illegal mandate because as of today, you don\u2019t have to.
