Lhamon (@CatherineLhamon) <a href=\"https:\/\/twitter.com\/CatherineLhamon\/status\/1387584146634117137?ref_src=twsrc%5Etfw\">April 29, 2021<\/a><\/p>\n<\/blockquote>\n<p>Lhamon held the same position in the Obama administration, with several key actions attributed directly to her, including her work to help draft the 2016 guidance to schools&nbsp;<a href=\"https:\/\/www.edweek.org\/leadership\/obama-admin-to-schools-no-restrictions-on-transgender-restroom-access\/2016\/05\">directing<\/a>&nbsp;them&nbsp;to allow transgender students to use bathroom and locker room facilities that correspond to their gender identity rather than their biological sex.<\/p>\n<p>In 2014, Lhamon also signed off on&nbsp;guidance that&nbsp;<a href=\"https:\/\/www.edweek.org\/teaching-learning\/new-federal-school-discipline-guidance-addresses-discrimination-suspensions\/2014\/01\">told<\/a>&nbsp;schools they could be investigated for violating federal civil rights law for racial disparities in their discipline decisions, with the presumption the disparities were due to institutional racism.<\/p>\n<p>Additionally, she issued the Title IX guidance that&nbsp;<a href=\"https:\/\/www.breitbart.com\/radio\/2020\/05\/07\/education-secretary-betsy-devos-title-ix-final-rule-balances-scales-of-justice\/\">placed<\/a>&nbsp;cases involving alleged campus sexual assaults in the hands of college administrators who held what many referred to as \u201ckangaroo courts,\u201d as they denied due process rights to accused students.<\/p>\n<p>During her confirmation hearing in July, Lhamon <a href=\"https:\/\/www.edweek.org\/policy-politics\/senate-confirms-catherine-lhamon-to-civil-rights-post-kamala-harris-casts-decisive-vote\/2021\/10\">told<\/a> senators Title IX protects students against gender identity discrimination as well as that pertaining to sexual orientation.
