Wood of the Supreme Court of Westchester County ordered the&nbsp;<em>New York Times<\/em>&nbsp;on Thursday to defend its publication last week of an article about legal memoranda addressed to Project Veritas and founder James O\u2019Keefe.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\" readability=\"10.266288951841\">\n<p lang=\"en\" dir=\"ltr\">!!! As noted, Project Veritas, like other news outlets, has lots of lawyers and lots of litigation.<\/p>\n<p>\u2014 Harmeet K. Dhillon (@pnjaban) <a href=\"https:\/\/twitter.com\/pnjaban\/status\/1461424603843100672?ref_src=twsrc%5Etfw\">November 18, 2021<\/a><\/p>\n<\/blockquote>\n<p>The decision stems from a <a href=\"https:\/\/www.foxnews.com\/media\/james-okeefe-gives-update-on-project-veritas-defamation-lawsuit-against-ny-times-pans-submitted-responses\">case<\/a>&nbsp;filed last year in which O\u2019Keefe is suing the <em>Times<\/em> for defamation. But it is related to the recent FBI raid on O\u2019Keefe\u2019s home in New York, because the <em>Times<\/em> only published its article after the raid.<\/p>\n<p>As Breitbart News <a href=\"https:\/\/www.breitbart.com\/the-media\/2021\/11\/07\/fbi-raids-james-okeefes-house-over-ashley-biden-diary\/\">reported<\/a> earlier this month, the FBI raid was ostensibly to look for information pertaining to the diary of President Joe Biden\u2019s daughter, Ashley Biden, which Project Veritas says it obtained legally, never published, and turned over to law enforcement.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>A week later, as Breitbart News <a href=\"https:\/\/www.breitbart.com\/the-media\/2021\/11\/12\/new-york-times-attacks-project-veritas-james-okeefe-for-using-lawyers\/\">noted<\/a>, the&nbsp;<em>Times<\/em> published an <a href=\"https:\/\/www.nytimes.com\/2021\/11\/11\/us\/politics\/project-veritas-journalism-political-spying.html\">article<\/a> about the legal advice given to O\u2019Keefe and Project Veritas by their lawyers. The paper quoted directly from the memos.<\/p>\n<p>As Breitbart News noted:<\/p>\n<blockquote readability=\"16\">\n<p>Technically, attorney-client privilege applies to communications from the client to the lawyer, not the other way around, though it could apply in this case if the lawyers cited communications from the client in their memos. Moreover, the \u201cwork product\u201d doctrine prevents opposing counsel from obtaining materials an attorney has prepared in advising a client.<\/p>\n<p>The&nbsp;<em>Times<\/em> notes that \u201cProject Veritas is suing The New York Times over a 2020 story about a video the group made alleging voter fraud in Minnesota.\u201d That raises questions about whether the&nbsp;<em>Times<\/em> article violated work product doctrine.<\/p>\n<\/blockquote>\n<p>Separately, a federal judge last week <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/11\/12\/court-halts-doj-extraction-of-james-okeefes-smartphone-data\/\">ordered<\/a> the Department of Justice to stop extracting data from O\u2019Keefe\u2019s smartphone, seized in the raid, until a hearing could be held on whether the court should appoint a \u201cspecial master\u201d to review materials to ensure that investigators were not given anything that infringed on attorney-client privilege.<\/p>\n<p>It is possible that the&nbsp;<em>Times<\/em> obtained legal memos relevant to the defamation case. It is not clear whether those memos came from law enforcement or other sources, though one of the&nbsp;<em>Times<\/em>&nbsp;journalists who wrote the article, Michael S. Schmidt, was part of the paper\u2019s Pulitzer Prize-winning coverage of the \u201cRussia collusion\u201d story, which relied on law enforcement sources but was exposed as a hoax.<\/p>\n<p>The&nbsp;<em>Times<\/em> must comply with the court order by Tuesday, Nov. 23.<\/p>\n<p><em>Joel B.
