Byron Donalds (R-Fla.), President Joe Biden knew the <a href=\"https:\/\/www.theepochtimes.com\/t-vaccine-mandate\">vaccine mandate<\/a> was unconstitutional, but he ordered it anyway to force people to comply until the court stopped him.<\/p>\n<p>\u201cJoe Biden knows this. He knows it\u2019s unconstitutional,\u201d Donalds told NTD\u2019s \u201cCapitol Report\u201d\u00a0<a href=\"https:\/\/www.ntd.com\/rep-donalds-mandates-go-against-fabric-of-our-nation_703191.html\">in an interview<\/a> premiered Wednesday, referring to Biden\u2019s COVID-19 vaccine mandate.<\/p>\n<p>\u201cWhat he\u2019s doing is playing \u2018catch me if you can\u2019 with the United States Constitution,\u201d the first-year congressman said. \u201cHe knows what he is doing is wrong. He already said before\u2014he doesn\u2019t have the legal authority to do it\u2014but he\u2019s doing it anyway.\u201d<\/p>\n<p>Biden had said multiple times that he wouldn\u2019t enforce a vaccine mandate. The most quoted one happened last December. Biden told reporters on Dec. 4, 2020, \u201cI don\u2019t think it should be mandatory. I wouldn\u2019t demand it to be mandatory.\u201d<\/p>\n<p>The White House has defended its policy shift. On Sept. 9, when Biden was going to sign the executive order to mandate federal employees to get vaccinated, his press secretary <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/press-briefings\/2021\/09\/09\/press-briefing-by-press-secretary-jen-psaki-september-9-2021\/\">Jen Psaki said<\/a>, \u201cObviously, information, data evolves, and the steps we need to take to address\u2014to get the virus under control, to help people return to normal\u2014has to evolve as well.\u201d<\/p>\n<p>\u201cThe reason we\u2019re here is because people have not gotten vaccinated\u201480 million of them\u2014not because of any other reason,\u201d Psaki continued. \u201cSo, what our objective is\u2014from the federal government\u2014is to continue to take bold and ambitious steps to get more people vaccinated and protect more people.\u201d<\/p>\n<figure id=\"attachment_3937293\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full\" src=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2021\/08\/06\/jen-psaki-in-green-1200x823.jpg\" width=\"1200\" height=\"823\" \/><figcaption class=\"wp-caption-text\"><noscript><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-3937293\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/11\/jen-psaki-in-green-600x412-1.jpg\" alt=\"Epoch Times Photo\" width=\"600\" height=\"412\" \/><\/noscript><\/figcaption>&nbsp;<\/p>\n<p>White House press secretary Jen Psaki speaks to reporters in Washington, on Aug. 6, 2021. (Win McNamee\/Getty Images)<\/figure>\n<p>Donalds said Biden is trying to threaten businesses and people with the force of law.<\/p>\n<p>\u201cThat is what the modern Democrat Party is. It is absolutely wrong. It\u2019s unconstitutional. And that\u2019s what the court is going to find.\u201d<\/p>\n<p>On Nov. 12, the Fifth Circuit Court of Appeals <a href=\"https:\/\/www.theepochtimes.com\/us-appeals-court-rejects-biden-challenge-over-covid-19-vaccine-mandate-for-private-businesses_4102012.html\">reaffirmed the hold<\/a> on Biden\u2019s vaccine mandate for private businesses with 100 workers or more. The mandate was ordered through a rule from the Labor Department\u2019s Occupational Safety and Health Administration (OSHA).<\/p>\n<p>Following the court\u2019s order,\u00a0<a href=\"https:\/\/www.theepochtimes.com\/osha-suspends-enforcement-of-vaccine-mandate-after-court-block_4108842.html\">OSHA said<\/a> it has suspended the implementation and enforcement of the mandate \u201cpending future developments in the litigation.\u201d<\/p>\n<p>\u201cThe Fifth Circuit is right. It is unconstitutional,\u201d Donalds told NTD. \u201cCongress never gave OSHA that authority. It was never even thought of in Congress to give OSHA that authority.\u201d<\/p>\n[\/epoch_video]\n<p>\u201cAlso, in our country, we have something called HIPAA laws that have been completely ignored during COVID-19,\u201d Donalds continued. \u201cThere\u2019s never been a time where we frankly say, \u2018you can\u2019t work here unless you take this.\u2019 That\u2019s medical discrimination.\u201d<\/p>\n<p>HIPPA <a href=\"https:\/\/www.cdc.gov\/phlp\/publications\/topic\/hipaa.html#three\">stands for<\/a> the Health Insurance Portability and Accountability Act of 1996. It is a federal law aimed to protect sensitive patient health information from being disclosed without the patient\u2019s consent or knowledge.<\/p>\n<p>Donalds believes the litigation about the mandate would go to the Supreme Court eventually, given so many lawsuits against it going on.<\/p>\n<p>\u201cWe are a free people in the United States. The government has no authority to tell me what I\u2019m going to inject into my arm,\u201d Donalds added, affirming he won\u2019t get the vaccine. \u201cIf Nancy Pelosi came out and said, \u2018I\u2019m issuing a vaccine mandate.\u2019 I will look at her and [say], oh, go find somebody to do it. Because trust me, it\u2019s not going in my arm.\u201d<\/p>\n<p>Donalds said if the vaccine harms somebody, then the federal government\u2014and probably the business owners as well\u2014would be culpable for it. The taxpayers, unfortunately, would be paying for that.<\/p>\n<p>\u201cBusiness owners need to take a long, hard look at this. Don\u2019t follow Joe Biden down a road that goes against the very fabric of our nation.
