Branca, a leading self-defense attorney and author, told <a href=\"https:\/\/www.dailywire.com\/news\/new-video-absolutely-calls-for-a-mistrial-with-prejudice-says-top-self-defense-lawyer\">The Daily Wire<\/a> on Wednesday that he believes there are \u201cabsolutely\u201d grounds for the trial to be dismissed with prejudice, meaning Rittenhouse could not be retried.<\/p>\n<p>Though the defense team earlier this week filed a motion asking for just that \u2014 a mistrial with prejudice, the team in court asked the judge Wednesday only once for a mistrial <em>without<\/em> prejudice, meaning Rittenhouse could be retried. The defense went as far as to say they \u201cknow\u201d the judge can\u2019t grant a mistrial \u201cwith prejudice.\u201d<\/p>\n<p>\u201cYou know, another name for a lawyer is advocate,\u201d Branca said Thursday morning on the legal Youtube channel <a href=\"https:\/\/www.youtube.com\/watch?v=Ids0kzPhl08\">Rekieta Law<\/a>. \u201cAnd I don\u2019t see these people advocating for their client, <em>fighting<\/em> for their client.\u201d<\/p>\n<p>\u201cMy perspective of the law is, if you\u2019re a criminal defense attorney, you\u2019re a fighter \u2014 you\u2019re a fighter for hire for that client,\u201d he continued. \u201cAnd to just sit there passively, like you\u2019re at some bureaucratic meeting where papers are gonna be shuffled and some mediator is gonna come to some decision, when the kid\u2019s life at stake. I mean, here\u2019s looking at life in prison without possibility of early release, worst case scenario.\u201d<\/p>\n<p>\u201cI don\u2019t know why they need to be urged to aggressively advocate for their client,\u201d Branca criticized, after it was noted the defense team could get a second-go at the trial if it\u2019s dismissed. \u201cIt shouldn\u2019t take the internet to tell them that, these are experienced attorneys.\u201d<\/p>\n<p>As highlighted by <a href=\"https:\/\/www.dailywire.com\/news\/watch-rittenhouse-prosecution-admits-they-sent-different-video-to-defense-team-blames-witness-email\">The Daily Wire<\/a>, the prosecution on Wednesday admitted that they gave the defense team a different video file, one of significantly lesser quality, than the drone footage the state had:<\/p>\n<p><em>Assistant District Attorney James Kraus conceded that the file he sent defense attorney Natalie Wisco was a different version of the drone video the state had, but blamed the email of&nbsp;Kenosha Detective Martin Howard,&nbsp;who testified in the case,&nbsp;for \u201ccompressing\u201d the file before Kraus eventually sent it to Wisco.<\/em><\/p>\n<p><em>Kraus told the court he had the larger file when Howard airdropped the video to him.
