I think that\u2019s part of the problem here,\u201d a former top Obama administration official told Business insider.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>\u201cHe seems incapable of making decisions. He\u2019s running it like it\u2019s a chambers, where he\u2019s going to have to write an opinion or something,\u201d the official&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.businessinsider.com\/merrick-garland-leadership-justice-department-frustrate-democrats-biden-white-house-2021-11\" target=\"_blank\" rel=\"noopener\">continued<\/a>. \u201cHe\u2019s been a judge, where people are super-nice to you all the time, No one really questions you. Somebody might write a dissent, but it\u2019s an academic dissent.\u201d<\/p>\n<p>Former Obama-era federal prosecutor Barb McQuade&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/www.businessinsider.com\/merrick-garland-leadership-justice-department-frustrate-democrats-biden-white-house-2021-11\" target=\"_blank\" rel=\"noopener\">echoed<\/a>&nbsp;the Obama administration official\u2019s sentiments. \u201cI think he\u2019s still feeling his way in the executive branch,\u201d McQuade said.<\/p>\n<p>Garland recently appeared at a congressional oversight hearing and drew criticism not only from the Republican Party but the Democrat Party as well.<\/p>\n<p>Republicans were critical of the Attorney General for reportedly&nbsp;<a class=\"editor-rtfLink\" href=\"https:\/\/apnews.com\/article\/merrick-garland-school-boards-violence-daaff3f659981354b7a9a536db5cf2e2\" target=\"_blank\" rel=\"noopener\">labeling<\/a>&nbsp;parents across the country as domestic terrorists. (Photo by Greg Nash-Pool\/Getty Images)<\/p>\n<\/div>\n<p>\u201cHe didn\u2019t do great, but a huge factor is that he\u2019s never been the type of individual that plays the political show that Republicans play. \u2026 We learned a lot from that oversight hearing,\u201d a Democratic Senate aide told Business Insider.<\/p>\n<p>Matt Miller, former Attorney General Eric Holder\u2019s top spokesperson, said, \u201c[Garland] could have walked into the hearing and said, \u2018You\u2019re damn right I\u2019m worried about the safety of school board members.\u2019\u201d \u201c\u2018The same way I\u2019m worried about the safety of election workers, the same way I\u2019m worried about your safety since your building was attacked on January 6th,\u2019\u201d Miller said.<\/p>\n<p>CNN\u2019s Jim Acosta recently called on Garland to prosecute former President Donald Trump for the January 6 riots at the U.S. Capitol.<\/p>\n<p>However, Garland recently doubled down on his Justice Department\u2019s commitment to impartiality.
