Officers were also directed to consider the \u201ctotality of the facts and circumstances.\u201d<\/p>\n<p>\u201cThe fact an individual is a removable noncitizen therefore should not alone be the basis of an enforcement action against them,\u201d Alejandro Mayorkas wrote in a <a href=\"https:\/\/www.ice.gov\/doclib\/news\/guidelines-civilimmigrationlaw.pdf\">memo<\/a> to the department\u2019s immigration enforcement agencies. \u201cWe will use our discretion and focus our enforcement resources in a more targeted way. Justice and our country\u2019s well-being require it.\u201d<\/p>\n<p>On Tuesday, Senate Judiciary Committee ranking member Sen. Chuck Grassley (R-IA) referenced this memo, asking Mayorkas whether this still applied to those who have a final removal order against them.<\/p>\n<p>\u201cWe cannot remove 1.2&nbsp; million individuals,\u201d Mayorkas responded. \u201cI would not necessarily accept the fact that all of them have received due process.\u201d<\/p>\n<p>As <a href=\"https:\/\/www.foxnews.com\/politics\/mayorkas-senate-hearing-migrant-response-new-border-numbers\">Fox News<\/a> reported, \u201cWhen asked if any of the 1.2 million people should be deported, Mayorkas said those \u2018who pose a public safety threat, who pose a national security threat, who pose a border security threat,\u2019 should be deported from the U.S.\u201d<\/p>\n<p>\u201cSen. Chris Coons, D-Del., defended DHS\u2019s use of \u2018prosecutorial discretion\u2019 in deciding which deportation cases to pursue.
