I\u2019ll tell you why it\u2019s outrageous. You don\u2019t indict somebody when you don\u2019t know what the law is. Nobody knows whether or not Bannon has the right to refuse to answer if the president tells him not to.&nbsp; That is a disputed question. That\u2019s not a proper subject for criminal indictment.\u201d<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Retention of executive privilege by former presidents is a disputed legal question, Dershowitz stated. He explained the legal process he recommended for investigation of such contentious issues of legality.<\/p>\n<p>\u201cYou go to court, you get a declaratory judgment, you get an injunction, you get a court order, and only then is it possible, but you don\u2019t use the criminal justice system except after you\u2019ve exhausted all the alternatives to try to find out what the law is,\u201d he said.<\/p>\n<p>\u201cWe don\u2019t know what the law is,\u201d he continued. \u201cIf you\u2019ve got 10 constitutional scholars in a room \u2014 not Larry Tribe, because he\u2019s not a constitutional scholar, he\u2019s a partisan advocate, he was a scholar, but he\u2019s now an advocate \u2014 but if you\u2019ve got 10 reasonable constitutional scholars in the room and you didn\u2019t tell them whether the person was a Democrat or a Republican, it would go five-to-five whether or not a former president has the authority to instruct his former adviser not to turn material over and not to testify.\u201d<\/p>\n<p>\u201c[It is] a hard, close question, not a proper subject for criminal indictment,\u201d he concluded.<\/p>\n<div class=\"entry-content\">\n<div class=\"entry-content\" readability=\"31\">\n<div class=\"entry-content\" readability=\"32\">\n<p><em>Breitbart News Sunday broadcasts live on SiriusXM Patriot 125 from 7:00 p.m. to 10:00 p.m. Eastern.<\/em><\/p>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The Justice Department\u2019s (DOJ) indictment of Steve Bannon is \u201coutrageous,\u201d Harvard Law School Professor Emeritus Alan Dershowitz, author of\u00a0,\u00a0said on SiriusXM\u2019s\u00a0Breitbart News Sunday\u00a0with host Joel Pollak.
