Things are different now.<\/p>\n<p>\u201cNow it\u2019s a fair fight,\u201d <a href=\"https:\/\/www.reuters.com\/world\/us\/judge-rittenhouse-trial-will-not-allow-jury-consider-lesser-charge-shooting-2021-11-12\/\">said<\/a> Wisconsin criminal defense attorney Patrick Cafferty. \u201cWithout that instruction they would have zero chance.\u201d<\/p>\n<p>Moreover, as USAToday reported, the jury is being instructed to hear lesser charges against Rittenhouse: \u201cJudge Bruce Schroeder said he would not include a lesser charge&nbsp;in the shooting of Joseph Rosenbaum&nbsp;but would include two lesser charges in the shooting of Anthony Huber.\u201d<\/p>\n<p>Milwaukee criminal defense attorney Craig&nbsp;Mastantuono says the instructions bolster prosecution, essentially allowing the state to \u201cthrow more against the wall to see if it sticks,\u201d the USAToday <a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2021\/11\/12\/kyle-rittenhouse-judge-jury-lesser-charges\/8587085002\/\">report<\/a> outlined:<\/p>\n<p class=\"gnt_ar_b_p\"><em>Lesser included charges are a way for the prosecution to give a jury more to consider and, possibly, find a defendant guilty, according to Milwaukee criminal defense attorney Craig&nbsp;Mastantuono, who is also&nbsp;an adjunct professor at Marquette University Law School.
