Garland in a <a href=\"https:\/\/www.justice.gov\/opa\/pr\/stephen-k-bannon-indicted-contempt-congress\">statement<\/a>.<\/p>\n<p>Bannon did not appear before the committee, made up of Democrats and anti-Trump Republicans, citing former President Trump\u2019s executive privilege.<\/p>\n<p>In the <a href=\"https:\/\/www.justice.gov\/opa\/press-release\/file\/1447811\/download?utm_medium=email&amp;utm_source=govdelivery\">indictment<\/a>, the Justice Department argues that Bannon was a private citizen when he was organizing and speaking with Trump about the January 6th protest after leaving the White House in 2017.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Bannon\u2019s attorney informed the committee he would not comply with the subpoena because Trump claimed the subpoena sought records and testimony that could fall under executive privilege.<\/p>\n<p>News of the indictment demonstrates the Biden administration\u2019s willingness to pursue former political rivals, opening up future administrations to possible prosecution.<\/p>\n<p>Previous American presidential administrations have resisted investigating their former rivals, even after promising during an election to do, on the merits of protecting executive privilege.<\/p>\n<p>Bannon faces up to one year in jail and up to a $1,000 fine for each count of contempt.<\/p>\n<p>The indictment comes one month after President Joe Biden said he <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/10\/15\/joe-biden-wants-justice-department-to-prosecute-trump-loyalists-defying-congressional-subpoenas\/\">believed<\/a> the Justice Department should indict Trump allies who defied the subpoenas.<\/p>\n<p>\u201cShould they be prosecuted by the Justice Department?\u201d a reporter asked Biden on October 15.<\/p>\n<p>\u201cI do, yes,\u201d Biden replied.<\/p>\n<p>Days later, Biden&nbsp;<a href=\"https:\/\/www.politico.com\/news\/2021\/10\/21\/biden-justice-department-jan-6-independence-516694\">admitted<\/a>&nbsp;his comment was \u201cnot appropriate,\u201d even though he ultimately shared his views about what the Justice Department should do.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>President Joe Biden\u2019s Justice Department indicted Steve Bannon on Friday, former President Donald Trump\u2019s one-time White House senior counselor and a former chairman of Breitbart News.
