While the administration <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2021\/09\/09\/remarks-by-president-biden-on-fighting-the-covid-19-pandemic-3\/#:~:text=this%20is%20a%20pandemic%20of%20the%20unvaccinated.\" target=\"_blank\" rel=\"noopener noreferrer\">said<\/a> the mandate was in response to an emergency surge of coronavirus cases, it was <a href=\"https:\/\/dailycaller.com\/2021\/11\/04\/private-businesses-january-4-joe-biden-vaccine-testing-requirement\/\">officially published<\/a> on Nov. 4 and won\u2019t go into effect until early 2022.<\/p>\n<p>More than 80 million Americans, or&nbsp;<a href=\"https:\/\/fred.stlouisfed.org\/series\/PAYEMS\">over half<\/a>&nbsp;of the U.S. working population, work for a business that has more than 100 employees,&nbsp;<a href=\"https:\/\/www.bls.gov\/web\/cewbd\/table_f.txt\">according<\/a> to Bureau of Labor Statistics data. <strong><a href=\"https:\/\/dailycaller.com\/2021\/11\/04\/biden-administration-lawsuits-challenging-vaccine-mandate\/\">(RELATED: Biden Administration Hit With Lawsuits Challenging Vaccine Mandate)<\/a><\/strong><\/p>\n<div id=\"attachment_7320612\" class=\"wp-caption alignnone\" readability=\"33\">\n<p id=\"caption-attachment-7320612\" class=\"wp-caption-text\">President Joe Biden pauses while speaking during a cabinet meeting on Friday at the White House. (Drew Angerer\/Getty Images)<\/p>\n<\/div>\n<p>\u201cApplying to 2 out of 3 private-sector employees in America, in workplaces as diverse as the country itself, the Mandate fails to consider what is perhaps the most salient fact of all: the ongoing threat of COVID-19 is more dangerous to some employees than to other employees,\u201d the Fifth Circuit ruling continued.<\/p>\n<p>The judges added that a \u201c28 year-old trucker\u201d who spends his work day alone is less at risk from coronavirus than a 62 year-old prison janitor. The mandate fails to consider the nuances of different workplaces and workers\u2019 different exposure risks, the court said.<\/p>\n<p>\u201cLikewise, a naturally immune unvaccinated worker is presumably at less risk than an unvaccinated worker who has never had the virus,\u201d the ruling said. \u201cThe list goes on, but one constant remains\u2014the Mandate fails almost completely to address, or even respond to, much of this reality and common sense.\u201d<\/p>\n<p>The White House didn\u2019t immediately respond to a request for comment.<\/p>\n<p><em>This is a breaking news story.
