The sentencing came after Chan&nbsp;<a href=\"https:\/\/news.rthk.hk\/rthk\/en\/component\/k2\/1616857-20211025.htm\">convicted<\/a> Ma of \u201cinciting secession by chanting pro-independence slogans\u201d on October 25.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>Chan ruled that Ma \u201cadvocated Hong Kong independence on 20 occasions, chanting slogans such as \u2018Liberate Hong Kong, Revolution of Our Times\u2019 and \u2018Hong Kong independence, the only way out,\u2019 and making pro-independence speeches\u201d between August and November 2020. State prosecutors said Ma also promoted his secessionist ideas online through social media accounts.<\/p>\n<p>Ma told the district court he had \u201cmerely exercised his freedom of speech\u201d through the slogans, as guaranteed under Hong Kong\u2019s Basic Law or de facto constitution. (Yan Zhao\/AFP via Getty Images)<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<\/div>\n<p>\u201c[E]ven though few people responded to Ma\u2019s chants, this didn\u2019t mean there was no incitement,\u201d the district court judge added, according to RTHK.<\/p>\n<p>\u201cThe defendant\u2019s various actions and speeches over a period of time \u2026 indicated clearly that he had every intention to incite others to follow his ideas and to push for the independence of Hong Kong,\u201d Chan wrote in his ruling.<\/p>\n<p>\u201cThe intention of the person incited is irrelevant. Nor is the prosecution required to prove that the incitee indeed carried out the offense incited,\u201d he clarified.<\/p>\n<p>Hong Kong residents traditionally enjoyed limited civil liberties under the city\u2019s Basic Law, which came into effect in July 1997 after Great Britain returned Hong Kong, a former British colony, to Chinese rule. The Basic Law <a href=\"https:\/\/www.legalhub.gov.hk\/details.php?a=10&amp;v=-one-country-two-systems-and-the-basic-law\">established<\/a> a \u201cOne Country, Two Systems\u201d policy that acknowledged Hong Kong as a part of China but allowed the city to retain its own legal system and select freedoms.<\/p>\n<p>China\u2019s ruling Communist Party began to impinge on Hong Kong\u2019s independent judiciary in February 2019 when it <a href=\"https:\/\/www.bbc.com\/news\/world-asia-china-47810723\">proposed<\/a> legislation that would have allowed the Hong Kong government to \u201cconsider requests from any country for extradition of criminal suspects, even countries with which it doesn\u2019t have an extradition treaty and including mainland China, Taiwan, and Macau,\u201d the BBC reported.<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>Thousands of people in Hong Kong took to the streets in March 2019 to <a href=\"https:\/\/www.reuters.com\/article\/us-hongkong-extradition-timeline\/timeline-key-dates-for-hong-kong-extradition-bill-and-protests-idUSKCN1TW14D\">protest<\/a> the extradition bill. (Anthony Kwan\/Getty Images)<\/p>\n<\/div>\n<p>The action spurred tens of thousands of people to demonstrate at Hong Kong\u2019s parliament on April 28, 2019, to urge the city\u2019s government to scrap the legislation. Protests against Hong Kong\u2019s extradition bill mushroomed over the next few months to include millions of participants at times. The intense backlash against the bill eventually forced Lam to indefinitely delay the proposed extradition law on June 14, 2019.<\/p>\n<p>Pro-democracy demonstrations continued in Hong Kong through the summer of 2020 despite the bill\u2019s scrapping a year prior. In an effort to quell the tenacious protest movement, the Chinese Communist Party\u2019s rubber-stamp legislature <a href=\"https:\/\/www.breitbart.com\/asia\/2020\/05\/28\/china-passes-national-security-law-suffocating-hong-kong\/\">passed<\/a> a national security law for Hong Kong and imposed it on the city on June 30, 2020. The law created four new crimes: terrorism, subversion, secession, and collusion with foreign forces.<\/p>\n<p>\u201cFor the four offences, \u2018serious\u2019 cases will generally attract penalties of at least 10 years and up to life imprisonment.
