Tuberville says Trump could ‘go around’ Constitution to serve third term

While Tuberville acknowledged that this scenario is unlikely and would face numerous legal challenges, he cautioned against completely dismissing the possibility given Trump’s unpredictability. Trump himself has hinted at a potential 2028 presidential run, citing strong poll numbers. However, other Republican leaders, including House Speaker Mike johnson, express skepticism about any feasible path for Trump to legally serve a third term, highlighting the difficulties of amending the Constitution.

Sen. Tommy Tuberville (R-AL) argued that President Donald Trump could “go around” the Constitution in order to serve a third term.
Speaking with reporters on Tuesday, Tuberville weighed into rumors that Trump could find a way to run for a third term, though the Constitution bars presidents from continuing after two terms.
“If you read the Constitution, it says it’s not, but if he says he has some different circumstances that might be able to go around the Constitution, but that’s a — we’ve got a long way to go,” he said.
When pressed, he said it was unlikely but possible.
“Well, I think that there’s going to have to be an evaluation from President Trump’s viewpoint to the Constitution. There will be a lot of legal aspects to it. Will it happen? It’s very unlikely, but don’t ever close the book on President Trump,” Tuberville concluded.
Trump has once again stoked rumors of a third term after briefly flirting with the possibility in the early months of his presidency.
“I would love to do it,” Trump said when asked about the prospect of a 2028 presidential bid.
“I have my best numbers ever. It’s very terrible. I have my best numbers,” he continued. “I haven’t really thought about it. We have some very good people, as you know…But I have the best poll numbers that I’ve ever had.”

Other leading Republicans in Congress have been more skeptical. House Speaker Mike Johnson (R-LA) said there was no path for the president to readily take due to the 22nd Amendment.
“I don’t see a way to amend the Constitution because it takes about 10 years to do that, as you all know, to allow all the states to ratify what two-thirds of the House and three-fourths of the states would approve,” Johnson said. “I don’t see the path for that.”
