Trump showers praise on Brett Kavanaugh for tariff dissent: ‘I’m so proud of him’

President Donald Trump praised Justice Brett Kavanaugh on Friday for his lengthy dissent to the Supreme Court’s ruling striking down the president’s sweeping tariffs.

“I would like to thank Justice Kavanaugh for, frankly, his genius and his great ability. Very proud of that appointment,” Trump said.

Trump held a press conference at the White House on Friday afternoon, hours after the high court ruled 6-3 that the International Emergency Economic Powers Act does not authorize the president to impose tariffs, effectively dooming his sweeping “Liberation Day” tariffs. Two of the justices in the majority, Justices Neil Gorsuch and Amy Coney Barrett, were nominated by Trump, while Kavanaugh was the lone Trump nominee in the dissent. The president gushed about Kavanaugh’s dissent, which outlined how Trump could still issue tariffs using other laws, and slammed the majority’s decision.

Trump specifically pointed to Kavanaugh’s argument that the majority “decision might not substantially constrain a President’s ability to order tariffs going forward,” and that “numerous other federal statutes authorize the President to impose tariffs and might justify most (if not all) of the tariffs at issue in this case.”

“He is right,” Trump said about Kavanaugh’s dissent. “In fact, I could charge much more than I was charging.”

Trump also praised the other two justices who dissented from the majority, Justices Clarence Thomas and Samuel Alito.

“You have to do what is right for the Constitution, which is why I respect so much Justices Thomas, Alito, and Kavanaugh. They not only dissented, but they dissented so strong,” Trump said.

“The good news is, like Justice Kavanaugh very strongly said, you have other ways you can go. There are numerous other ways you can go,” he added.

Trump nominated Kavanaugh in 2018 to replace retiring Justice Anthony Kennedy and stood by him despite allegations of sexual assault from decades prior that emerged against Kavanaugh during his confirmation process. Kavanaugh has unequivocally denied the allegations, which were never proven and contained inconsistencies. Trump refused to pull Kavanaugh’s nomination, and the Senate voted to confirm him to the high court.

When asked about his other two nominees to the Supreme Court, Gorsuch and Barrett, joining the majority that struck down his tariffs, Trump said he was “surprised” by their decision but would not go as far as saying he regrets nominating them.

“I don’t want to say whether or not I regret, I think their decision is terrible,” Trump said. “I think it is an embarrassment to their families, if you want to know the truth, the two of them.”

Trump said during his lengthy press conference that he will pursue his sweeping tariff agenda by using other laws, after the high court ruled IEEPA does not give him tariff powers.
