Supreme Court Strikes Down Biden’s Student Debt Cancellation Program

In a major blow to President Joe Biden’s agenda, Chief Justice John Roberts quoted former House Speaker Nancy Pelosi (D-CA) in the majority opinion that deemed the student debt cancellation program unconstitutional.

The program aimed to provide relief to borrowers with federal student loans, forgiving up to $10,000 for those with incomes below a certain threshold and up to $20,000 for Pell Grant recipients. However, the Supreme Court ruled against it by a 6-3 margin, with Roberts emphasizing that Biden lacked the authority to act unilaterally on the issue under the COVID-era HEROES Act.

“The Secretary asserts that the HEROES Act grants him the authority to cancel $430 billion of student loan principal. It does not. We hold today that the Act allows the Secretary to ‘waive or modify’ existing statutory or regulatory provisions applicable to financial assistance programs under the Education Act, not to rewrite that statute from the ground up,”

Roberts further supported his argument by referencing Pelosi’s own statement, where she acknowledged that Biden had the power to make changes in the time or manner of payments but not to waive them entirely. Pelosi had stated, “People think that the President of the United States has the power for debt forgiveness. He does not. He can postpone. He can delay. But he does not have that power. That has to be an act of Congress.”

Despite Pelosi’s previous skepticism, she later appeared to support the plan. In August of 2022, she praised Biden’s efforts in a tweet, stating that his “bold action is a strong step in Democrats’ fight to expand access to higher education” and that it would provide historic relief to millions of borrowers.

Pelosi has not yet commented on the Court’s decision to strike down the program entirely.
