The Supreme Court to Consider Second Amendment Rights in Domestic Violence Case

The Supreme Court has agreed to hear a case that will test the scope of the high court’s Second Amendment ruling from last summer. The case involves the question of whether individuals accused of domestic violence have a right to own firearms.

The Biden administration has appealed in defense of a federal law that prohibits individuals subject to domestic violence restraining orders from possessing a firearm. The case centers around Zackey Rahimi, a Texas-based man who is appealing his conviction for violating this federal law.

Rahimi argues that the Supreme Court’s landmark decision in New York Rifle & Pistol Assn. v. Bruen means that the federal law also violates the Second Amendment. Last year’s decision struck down a New York law that restricted who could obtain a license to carry a handgun in public.

The Supreme Court’s new test has sparked a series of lawsuits by states and gun control advocates seeking to establish historical precedents for modern gun regulations. The U.S. Court of Appeals for the 5th Circuit ruled in favor of Rahimi, stating that the law was a historical “outlier” that would not have been accepted by our ancestors.

Background of the Case

Rahimi was involved in five shootings in the Arlington area between late 2020 and early 2021. After identifying him as a suspect, police obtained a warrant to search his home, where they discovered a rifle and a pistol. They also found a copy of a restraining order issued against Rahimi in 2020 following a physical altercation with his then-girlfriend.

The case, known as U.S. v. Rahimi, is expected to be heard by the justices later this year.
