Special Counsel Jack Smith Expresses Concern Over Trump’s Social Media Posts
In a court document filed on Tuesday, special counsel Jack Smith raised concerns about the potential prejudice caused by former President Donald Trump’s statements on social media and other platforms. The document, titled “Government’s Opposition to Defendant’s Motion to Vacate,” was filed in the U.S. District Court in Washington, D.C.
Trump’s legal team had filed a Motion to Vacate, seeking new processes for handling “Sensitive Materials” that are relevant to the case but have not been approved for public release. In response, Smith’s team argued that the court had already issued a Protective Order that addressed the handling of such materials, stating that any unredacted Sensitive Materials should be submitted under seal.
Trump’s team had also requested an alternative “three-week briefing process,” which Smith’s team deemed “unworkable.” The filing stated that such a requirement would bring the litigation to a halt, especially considering the pressing matters before the Court, including Trump’s daily extrajudicial statements that could potentially prejudice the jury pool.
Smith’s team likely had in mind statements like those found on Trump’s Truth Social account, as reported by Politico senior legal affairs reporter Kyle Cheney.

The potential impact of such statements on the pool of potential jurors is a matter open to debate.
According to Cheney’s post on the social media platform formerly known as Twitter, Judge Tanya Chutkan sided with Trump’s attorneys and granted the Motion to Vacate.
