SpaceX Countersues Hiring Discrimination Lawsuit By DOJ

Elon Musk-owned company SpaceX has successfully halted the Department of Justice’s hiring discrimination lawsuit through a court order.
SpaceX recently won a court ruling that effectively blocks the United States Department of Justice’s (DOJ) lawsuit. According to a report, the lawsuit alleged that the rocket company engaged in discriminatory practices against “immigrants and asylum seekers” during its hiring process.
U.S. District Judge Rolando Olvera in Brownsville, Texas, rejected the DOJ’s case, stating that the administrative judges responsible for anti-immigration bias cases at the DOJ were not “properly appointed.”
In a post on X, formerly Twitter, Musk expressed his frustration, claiming that SpaceX was repeatedly warned that hiring non-U.S. permanent residents would violate international arms trafficking laws, which is a criminal offense. Musk believes that the DOJ’s actions are politically motivated and an abuse of power.
The SpaceX founder and CEO firmly believes that the DOJ is using its authority for political gain.
The DOJ’s lawsuit, filed in August, accused SpaceX of consistently excluding refugees and asylum seekers from job applications, neglecting to review their applications, and rejecting them based on their citizenship status.
SpaceX cited control laws such as the International Traffic in Arms Regulations to justify its hiring practices, as rockets are considered “advanced weapons technology,” according to the lawsuit.
In response, Musk’s company filed a counter-lawsuit, denying the allegations and asserting that they are “unconstitutional.”
According to SpaceX, the administrative law judge overseeing the case has an “unconstitutional insulation from Presidential authority.”
Furthermore, SpaceX argues that the case should be heard in a federal court rather than an administrative proceeding, as it is being denied its right to a jury trial.
The Texas judge agreed with SpaceX’s arguments and ruled in their favor, stating that the Constitution requires judges to be appointed by the president and confirmed by the U.S. Senate.
This is not the first time SpaceX has faced accusations of discrimination. In October, a former employee filed a lawsuit alleging that the company paid females and minorities less than their white male counterparts. Tesla, another company founded by Musk, also faced a racial discrimination lawsuit in 2022 when several Black employees claimed mistreatment at Tesla’s California factory.
