Sen. John Kennedy Warns Passage of Judicial Ethics Bill Would be “Dangerous” and a “Court-Killing Machine”
Sen. John Kennedy (R-LA) issued a strong warning to his colleagues in the Senate, stating that the passage of a judicial ethics bill would have dire consequences. His remarks came after Senate Democrats successfully moved the bill out of committee.
The bill, which aims to establish a code of ethics for the Supreme Court, was approved by the Senate Judiciary Committee along party lines. If it receives full Senate approval, the bill would compel the court to form a group responsible for investigating alleged violations of the code of conduct and other laws. It would also enhance transparency when a justice has a connection to a party involved in a case.

“You don’t have to be ‘Oliver Wendell Scalia’ to figure out that this legislation is meant to be a court-killing machine,” Kennedy asserted, as reported by Fox News. “It would allow any jackaloon out there in America, wearing a tinfoil hat and whose own dog thinks he’s an utter nutter, to file a motion to recuse a United States Supreme Court Justice.”
The proposed law would require Supreme Court justices to provide explanations for recusing themselves from a case.
The bill was co-sponsored by Sens. Sheldon Whitehouse (D-RI) and Dick Durbin (D-IL) following reports alleging that Supreme Court justices had accepted lavish gifts and were profiting from their positions. Durbin has also conducted Judiciary Committee hearings on Supreme Court ethics.

“We just advanced Supreme Court ethics reform out of the Senate Judiciary Committee,” Durbin tweeted on Thursday. “Chief Justice Roberts failed to act on ethics reform before adjourning the Supreme Court for the summer. I said from the beginning: if the Court won’t act, Congress will.”
The bill will now proceed to the Senate, where it will require 60 votes to pass. However, Kennedy cautioned on Wednesday that the bill will be “dead as a fried chicken” if it reaches the Senate floor.
