As the Pennsylvania House takes a stand against junk fees, these less-than-transparent charges are gaining national attention. “These fees have been spreading like wildfire,” exclaimed Nidhi Hegde, managing director of the American Economic Liberties Project, during a recent event on junk fees and state legislatures’ actions.
The Pennsylvania House passed a bill in October, with an overwhelming 172-31 majority, that would require all fees to be included in the price displayed to potential buyers. This bill covers various sectors, including rental or hotel bookings (such as Airbnb and Expedia), food delivery services (like GrubHub and DoorDash), and ticket platforms (such as Ticketmaster and StubHub).
Currently, the bill awaits action in the Senate Consumer Protection and Professional Licensure Committee. Advocates argue that if this bill becomes law, it would be a significant victory for transparency and fairness.
“The predatory junk fee industry has infiltrated many aspects of our regular purchases and payments to the point where we simply accept it as the cost of doing business. But it doesn’t have to be that way,” emphasized Rep. Nick Pisciottano, D-West Mifflin, the sponsor of the House bill.
Pisciottano believes that forcing disclosure of these fees would help curb unfair business practices.
“Sunshine is the best disinfectant; our idea was if you basically force these fees to be disclosed, you really disincentivize the use of fees at all,” Pisciottano explained. ”People understand and recognize it’s a big problem that we need to tackle. I’m optimistic that we can keep the legislation moving in the Senate in 2024 and continue the fight to ensure our economy works better for everyone.”
Pat Garofalo, director of state and local policy at the American Economic Liberties Project, sees the battle against junk fees as a matter of fairness.
“This is a fairness question,” Garofalo asserted. “It’s about not pretending that your products cost one thing when they really cost something else.”
Arizona is also taking a strong stance against junk fees with an even more comprehensive bill, spearheaded by Rep. Analise Ortiz, D-Maryvale, targeting rental fees. Several other state legislatures have also proposed bills to combat junk fees.
In October, the Biden administration made junk fees a national issue. FTC Commissioner Linda Khan and Consumer Financial Protection Bureau Director Rohit Chopra announced a crackdown on the banking industry for overdraft fees and other penalties.
Jon Donenberg, deputy director of the National Economic Council in the White House, compared the elimination of junk fees to nutritional labels that allow customers to make easy comparisons.
“These things can really add up. The fees are purposefully deceptive,” Donenberg warned. “Hidden junk fees don’t simply raise prices—they also make it harder for consumers to accurately comparison-shop and distort competition.”
