Parents sue school district over girls being told to ‘tolerate’ alleged ‘threatening’ encounter with exposed male in bathroom.

Four High School Girls Sue‌ School District Over Bathroom Policy

Four high school girls ⁤under the age of 18 have, through their guardians, filed a lawsuit against a Michigan school district, its superintendent and assistant superintendent, and​ their high school principal and vice-principal. The lawsuit alleges that the ⁢girls were forced to accept the presence of biological males in facilities, such as restrooms and locker rooms, that were designed ​for use by female students.

“This case is about the intentional violation of children’s fundamental right to bodily privacy contrary to constitutional and statutory principles, including the Fourteenth ‍Amendment,” the lawsuit⁢ reads.

The lawsuit claims that Vicksburg High School has allowed boys into these areas without informing the students or their ‌parents. When ‌the girls reported an incident where a boy exposed ⁣himself‍ in the girls’ bathroom, they were dismissed by school administrators ⁣who⁤ claimed that “the law was settled” and that they should “tolerate it” and make it as “natural” as possible.

“Defendants told Plaintiffs they needed to ⁢‘tolerate ‍it’ and make it as ‘natural’‍ as they possibly‍ could,” the suit reads. A tacit admission,‌ if true, that the situation is indeed⁤ unnatural. — Ed. note

The⁣ girls also allege that they were instructed not to embarrass the‍ biological male student and ⁣were told to “look away” ⁢and not “bully” him. The lawsuit argues that⁤ other female students have also expressed⁤ fear and anxiety⁤ about sharing ⁣restrooms with‌ boys, with some ‍choosing to‍ hold their urine all day rather than use the school‌ restroom.

“Many female students are using the bathroom only one time a day out ⁣of fear and anxiety that a male ​student could⁣ be using the bathroom with them,” one mother, ⁢identified only as “Heather,” told WWMT.

The lawsuit also mentions an incident where a biological male using the girls’ restroom stared down one of the‌ plaintiffs⁢ in⁢ a threatening manner, causing her to fear for her safety.

The plaintiffs’⁢ attorney, Matthew DePerno, stated that school ​officials had not informed students or parents ‌about the ⁢change in policy and that the principal ⁢had told ‌them there was nothing they could do about it.

“The biological males who want to use the girls’ restrooms, in other school districts they are denied that ‌and provided with a unisex bathroom to use,” he argued.

The local school board​ president expressed⁣ dissatisfaction with the​ policy at a meeting, stating that current binding⁢ case law in Michigan requires public schools ⁤to ‌allow transgender students to use restrooms that⁣ correspond with their gender identification.

“You need‍ to take it up with your state‌ legislators,” he said. “We need to have some action at the state ​level, we are kind of caught in the middle of ⁣it all.”

Legal Action and Demands

The families involved in the lawsuit are seeking admissions from the defendants that ⁣their actions were illegal. ⁣They are also demanding an end to ⁢the policy that allows boys to use girls’ restrooms and locker rooms, as well as court and attorney costs. Additionally, they are seeking compensatory damages​ for‌ the violation of their constitutional and statutory rights, ⁢with an amount greater than $30,000.

The lawsuit was filed on‍ August 25, and a court date has not yet been set.
