NY to offer ‘X’ gender option for public assistance applicants.

New Yorkers will soon have the exciting opportunity to select an “X” gender option when applying for food stamps, Medicaid, and other public assistance, thanks to a groundbreaking court settlement.
On Wednesday, a historic court settlement was reached in response to a 2021 lawsuit against several government agencies. The lawsuit argued that the state Office of Temporary and Disability Assistance’s computer system forced nonbinary individuals to either lie about their gender or be denied certain benefits.
Under the settlement, by January 1st, 2024, New York’s public assistance and health agencies will implement the inclusion of “X” gender markers on relevant forms.
This means that the NYC Human Resources Administration will be able to accommodate “X” gender markers on application forms, as confirmed by the state’s Civil Liberties Union, which fought the lawsuit on behalf of multiple plaintiffs.
“This is a monumental victory for the thousands of nonbinary New Yorkers who will no longer have to lie about their identity or risk being misgendered when seeking public benefits,” stated NYCLU attorney Gabriella Larios.
It’s important to note that this nonbinary gender option is already available on New York driver’s licenses and birth certificates.
While United States citizens have been able to select “X” on their passport applications since April 2022, this marks the first time the option is being extended to public assistance applications.
The Office of Temporary and Disability Assistance has been contacted for comment. The organization previously announced that a multimillion-dollar software upgrade would be implemented to accommodate the additional gender option.
