A gag order prohibiting former President Donald Trump from criticizing court employees was reinstated by a New York appeals court.
On Thursday, the court restrained a gag order that forbids the 45th president and his attorneys from making public statements about the courtroom staff in his fraud case.
New York Judge Aurthur Engoron first issued the gag order in early October following a series of social media posts by Trump that were directed at one of his law clerks.
Attorney General Letitia James of New York is accusing Trump of business fraud, which Trump is currently defending against.
Judge David Friedman of the Appeals Court put a stay on Engoron’s gag order, citing possible First Amendment violations by Trump.
By then, Engoron had already fined Trump $5,000 for breaking the order on social media on October 20th and another $10,000 on October 25th before threatening to put him in jail if more infractions occurred.
Early in November, Trump stood to testify on his own behalf. He continuously painted James’s lengthy inquiry and legal action as a “disgrace” and an assault on both his company and his family.
Trump maintains that his assets were genuinely valued and he has since denied any misconduct and stated on numerous occasions that there were Disclaimers in his financial statements, requesting that the banks review the figures.
In September, Ergon ruled that both Trump and his attorneys had committed fraud by deceiving those overvaluing his assets, including banks and insurers.
“They are defending the Worst and Least Respected Attorney General in the United States, Letitia James, who is a Worldwide disgrace, as is her illegal Witch Hunt against me. The Radical and Unprecedented actions of Judge Engoron will keep BUSINESSES and JOBS forever out of New York State,” Trump wrote.

The reinstatement of the gag order comes as a blow to Trump and his legal team, restricting their ability to publicly comment on the ongoing fraud case. This order aims to prevent any further defamation or interference with the court proceedings.
Trump’s vocal criticism and attacks on court employees have been a recurring theme throughout his presidency and even after leaving office. His social media posts directed at Judge Engoron’s law clerk prompted the initial issuance of the gag order in October.
The Attorney General of New York, Letitia James, has accused Trump of business fraud and is currently pursuing legal action against him. Trump, on the other hand, vehemently denies any wrongdoing and views James’s inquiry as an attack on his company and family.
Judge David Friedman’s decision to put a stay on Engoron’s gag order raises concerns regarding potential First Amendment violations by Trump. However, Engoron had already fined Trump twice for breaking the order on social media, demonstrating the court’s determination to enforce the order.
In his testimony in November, Trump continued to assert the legitimacy of his assets’ valuation and denied any misconduct. He emphasized the presence of Disclaimers in his financial statements instructing banks to review the figures.
In September, Judge Engoron ruled that both Trump and his attorneys had committed fraud by misleading institutions regarding the value of his assets. This ruling formed the basis of the ongoing fraud case against Trump.
Trump’s response to the reinstatement of the gag order reflects his continued defiance and criticism of the court proceedings. He accuses Letitia James of conducting an illegal witch hunt and condemns the actions of Judge Engoron, claiming that they will have negative implications for businesses and jobs in New York State.
The outcome of the fraud case against Trump remains to be seen, but these recent developments highlight the tension and controversy surrounding the legal proceedings.
