Judge Threatens Sanctions Against Hunter Biden’s Lawyers Over Alleged Misrepresentation
A judge has issued a warning to lawyers representing Hunter Biden, stating that they could face sanctions for an alleged act of deception. It is claimed that a member of their team misrepresented themselves to a court clerk over the phone in order to have certain records removed from the docket.
The threat from District Judge Maryellen Noreika came just before a scheduled hearing to consider a plea deal for tax and gun violations, which could potentially keep Hunter Biden out of prison.
“It appears that the caller misrepresented her identity and who she worked for in an attempt to improperly convince the clerk’s office to remove the amicus materials from the docket,” Noreika said in an order on Tuesday, according to the Daily Mail.
The judge has ordered Hunter Biden’s lawyers to provide an explanation as to why sanctions should not be considered for their misrepresentations to the court.
The controversy revolves around an amicus brief from a law firm representing House Ways and Means Committee Chairman Jason Smith (R-MO). The brief urges the court to consider whistleblower allegations from IRS agents, who claim that the criminal case against Biden has been deliberately delayed, preventing more serious charges from being brought against him.
Biden’s lawyers have claimed that the clerk removed documents from Smith’s legal team from the docket without their involvement. They also stated that the documents contained personal tax information and a call was made to have them hidden under seal.
Smith’s attorney, Theodore Kittila, promptly contacted the clerk’s office to clarify the situation, stating that the representation made by the caller was inaccurate.
The judge has temporarily sealed the transcripts from the whistleblowers, which are publicly available, until after the plea hearing.
Decision on Plea Deal to be Made at Hearing
The judge will make a decision on whether to accept the plea deal negotiated between Hunter Biden’s lawyers and the Department of Justice (DOJ) at the upcoming hearing, scheduled for 10 a.m.
