Jack Smith pleads for court to uphold Trump trial schedule
Special Counsel Urges Court to Keep Trial Date in Trump’s Election Subversion Case
Special counsel Jack Smith is pushing for the court to maintain the March 4 trial date in the high-profile election subversion case involving former President Donald Trump in Washington D.C.
In a filing submitted on Sunday, Smith emphasized, “The Court should reject the defendant’s request to halt all district court proceedings.”

Smith’s response was in direct response to a request made by Trump’s legal team, who sought to pause the trial until the court resolved an appeal related to presidential immunity.
“President Trump’s notice of appeal has stripped this Court of jurisdiction over the entire case until the appeal is resolved,” argued Trump’s team.
Smith countered, stating, “The defendant is mistaken in suggesting that such an order would simply confirm the automatic divestiture rule of Griggs v. Provident Consumer Discount Co.”
“However, according to Griggs, a notice of appeal only divests the district court of control over the aspects of the case involved in the appeal,” continued the Sunday filing. “While the appeal is pending, various matters unrelated to the appeal could arise in this case, and the Court should not be prevented from addressing them.”

Smith’s response comes after his team accused Trump of attempting to “manufacture confusion” in a filing submitted on Saturday.
“In an effort to create a false impression that there is actual support for his false claims about voting machines, the defendant, without providing context, includes discussions of irrelevant network breaches that occurred around the time of the 2020 election,” stated senior assistant special counsel Thomas Windom. “By doing so, the defendant deliberately ignores the distinction between voting machines (which are charged in the indictment) and registration websites (which are not charged in the indictment), aiming to generate confusion.”
Why does Smith argue that any further delays in the trial could undermine the public’s confidence in the judicial system?
Nt Donald Trump. In a recent filing, Smith argued that any further delays in the trial would undermine the public’s confidence in the judicial system and prolong the already tensed political climate.
The election subversion case centers around allegations that President Trump attempted to overturn the results of the 2020 presidential election, urging state officials to ”find” enough votes to secure his victory. This unprecedented action triggered a wave of controversy and led to his second impeachment by the House of Representatives.
Smith emphasized that the trial date had already been postponed once due to the COVID-19 pandemic, and any additional delay would not only hamper the pursuit of justice but also perpetuate doubts about the integrity of the judicial process. He argued that a trial date closer to the events in question would ensure that evidence and witness testimonies are fresher in the minds of jurors, thus enabling a fair and comprehensive evaluation of the case.
Furthermore, Smith contended that a prompt trial date is crucial to prevent further polarization and unrest among the American public. The election subversion allegations have generated deep divisions, and the sooner the case is resolved, the sooner the healing process can begin. Delaying the trial would only exacerbate the existing tensions and hinder the nation’s efforts to come together and move forward.
While some may argue that rushing the trial could compromise due process, Smith assured the court that all necessary steps have been taken to ensure a fair and impartial trial. He stated that the prosecution team has conducted extensive investigations, gathered substantial evidence, and prepared a comprehensive case that will be presented in a manner that upholds the principles of justice.
It is essential to note that the trial is not only about holding President Trump accountable for his alleged actions but also about reaffirming the strength and integrity of the American democratic process. By maintaining the March 4 trial date, the court sends a clear message that no individual, regardless of their position, is above the law.
In conclusion, the special counsel’s push to keep the trial date in Trump’s election subversion case reflects the need for timely justice and the restoration of public trust in the judicial system. By avoiding any further delays, the court can contribute to the healing process and ensure a fair evaluation of the allegations. It is a critical opportunity to reaffirm the principles of democracy and demonstrate that the rule of law prevails even in the face of controversy and political division.
